Dear Sirs:

Enclosed are copies of prepared written testimony for Li-censee's four witnesses on the mailgram issue -- Messrs.

Dieckamp, Lowe, and Van Witbeck and Dr. Zebroski. Licensee does not anticipate the need to introduce into evidence as part of its affirmative case on the mailgram issue any exhibits be-yond those included in the stipulation of the parties.

Licensee and the other parties recently have been dis-cussing modifications to the existing stipulation on documents which the Board earlier approved. Enclosed is Licensee's un-derstanding of the documents which are the subject of the stip-ulation, as modified, although the parties have not completed discussions nor executed the Modified Stipulation. Licensee has proposed to TMIA that we complete and execute the Modified Stipulation no later than November 5. This will allow adequate time for copying and binding of the documents and distribution to the Board in advance of the hearing.

Licensee has discussed with Staff and TMIA counsel the se-quence and timing of Licensee's witnesses. Licensee expects to call Mr. Lowe as its first witness on November 14; Mr. Lowe is scheduled to leave the country on November 16. Dr. Zebroski who is available only on November 16 to provide his testimony will be called that day. Mr. Van Witbeck has indicated he will i be available during November 14-16.
