POWER AUTHORITY OF THE STATE OF NEW YORK JAMES A. FITZPATRICK NUCLEAR POWER PLANT DOCKET NO. 50-333 i

1.0 INTRODUCTION
i By letter dated July 21, 1995, the Power Authority of the State of New York (the licensee) submitted a request for changes to the James A. FitzPatrick Nuclear Power Plant (FitzPatrick) Technical Specifications (TSs).
The requested changes would revise TS Section 6.0 (Administrative Controls) to replace the title-specific list of members on the Plant Operating Review Committee (PORC) with a more general statement of membership requirements, and i
j expand the scope of disciplines represented on the connittee to include 1
Nuclear Licensing and Quality Assurance. The proposed amendment would also change the following management position titles:
"First Executive Vice l
President and Chief Nuclear Officer" to " Chief Nuclear Officer", " Resident Manager" to " Site Executive Officer," " Shift Supervisor" to " Shift Manager,"
and " Assistant Shift Supervisor" to " Control Room Supervisor." These changes in title do not affect the reporting relationships, authority, or responsibilities of these positions.
Finally, the proposed amendment would j
also make editorial corrections to the TSs.
2.0 EVALUATION l
2.1 Plant Operating Review Committee (PORC) Changes:
I Currently, in accordance with TS 6.5.1.2, the PORC is comprised of the following: Chairman - General Manager, Operations; Vice-Chairman / Member -
General Manager, Support Services; Vice-Chairman /Me:nber - General Manager, Maintenance; and the following Members - Operations Manager, Maintenance Manager, Technical Services Manager, Instrument and Controls Manager, Radiological and Environmental Services Manager, Site Engineering Manager, Reactor Analyst Supervisor, and special consultants as needed.
The proposed revision would read as follows:
"The Plant Operating Review Committee shall be composed of a Chairman, Vice-Chairmen and members designated in writing by the Site Executive Officer. Members shall collectively have responsibility in at least the areas of Operations, Maintenance, Radiological and Environmental Services, Engineering, Reactor Engineering, Instrumentation and Controls, Nuclear Licensing, and Quality Assurance." Quorum would-be revised to read in part "... Chairman or a Vice-4 Chairman..."instead of "... Chairman or one of two Vice-Chairmen..." for consistency with the changes in Specification 6.5.1.2.
The licensee indicated that changes in organization and position titles affect the list of designated PORC members.
The proposed approach to replace the title specific positions for PORC membership with a description of membership requirements reduces the need for future license amendments.
Specific individuals who have responsibility in these disciplines will be designated in writing by the Site Executive Officer. The addition of nuclear licensing and quality assurance disciplines on PORC will provide additional expertise and will provide an additional mechanism for the oversight function to be performed.
The NRC staff has reviewed the proposed changes to TS Section 6.0 resulting 4
from the new PORC membership criteria and has concluded that they are acceptable since they are administrative in nature and do not involve any j
changes that would reduce plant safety.
2.2 Management Title Changes:

The licensee.
has indicated that these title changes would be administrative changes that do not affect the reporting relationship, authority, or responsibility of the positions.
The NRC staff has reviewed the proposed changes to the TS resulting from the new organization and position titles and has concluded that they are acceptable.
l 2.3 Editorial Changes l
The licensee has proposed the following editorial changes to the FitzPatrick TSs:
(1) TS 6.7(A) to correct a reference to a section of Title 10 CFR Part 50.
The citation should be 10 CFR 50.36(c)(1)(i).
(2) TS 6.12 to remove the requirement for PORC and SRC to review annually the Plant Security Plan.
This requirement was previously removed from PORC and SRC responsibilities identified in TS 6.5.1.6 and 6.5.2.9 by Amendment 222, dated December 22, 1994, but was not also removed from TS 6.12.
In addition to this administrative change, TSs 6.12 and 6.14 are reformatted.

TS 6.11(A)2, changing the title " Radiological and Environmental Services Superintendent" to " Radiological and Environmental Services Manager."
This is a title change reflected previously in TS 6.5.1.2.

n-1 (4) Grammatical errors are corrected in TS 6.2.2.5 ("an" vs. "a"- two places) and TS 6.5.2.11 is reformatted for consistency.
The NRC staff has reviewed the proposed editorial changes to TS Section 6.0 and has concluded that they are acceptable since they are' administrative in nature and do not involve any changes that would reduce plant safety.
3.0 STATE CONSULTATION
In accordance with the Commission's regulations, the New York State official was notified of the proposed issuance of the amendment.
The State official had no comments.

4.0 ENVIRONMENTAL CONSIDERATION
This amendment changes recordkeeping, reporting, or administrative procedures or requirements.
Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10).
Pursuant 10 CFR 51.22(b) no enviromental impact statement of environmental assessment need be prepared in connection with the issuance of this amendment.
5.0 CONCLUSION
The Commission has concluded, based on the considerations discussed above, that:
(1).there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3).the issuance of the amendment will not be inimical to the common defense and securtty or to the health and safety of the public.
