Report on the Status of the Nine Mile Point Nuclear Station NPDES /SPDES Discharge Pennit and Any Occurrences of Non-Compliance Gentlemen:

This report is being issued to keep you informed of changes in the Nine Mile Point Nuclear Station's NPDES /SPDES Discharge Permit (No. NY-000-1015) and occurrences of permit non-compliance. During the reporting period of January through June 1995, the station was unable to meet the requirements of the NPDES /SPDES Discharge permit on five occasions.

The occasions are categorized below for two s;parate areas: permit conditions, and permit effluent limitations.

i Permit Conditions

On two (2) occasions, a non-safety related multi-parameter strip chart recorder that records continuous input from the plant process computer for Unit 2 intake-discharge temperature  ;
difference and flow was inoperable for short periods due to routine testing / calibration. On

L both of the above occasions, maximum water flow and/or temperature data from the period j prior to or following the testing / calibration was used during these periods. Niagara Mohawk l l

considers these occasions to have no impact on the environment. A description and impact  !

of these occurrences were included in the comments section of the monthly Discharge l I

Monitoring Reports sent to the NYSDEC.

Permit Effluent Limitations

! On three (3) separate occasions, the station was unable to meet the requirements of the NPDES /SPDES Discharge Permit relative to permit effluent limitations. All three of the occasions occurred at Unit 1.

The first occasion occurred when the Unit I copper level associated with Outfall 010 was exceeded following restart of the circulating water pumps. This exceedance represented a one-time flushing action of the main condenser, which had been cleaned during the February-March Refuel Outage, and was not indicative of normal plant operation. ,

Page 2 The other two occasions occurred when the site Sewage Treatment Plant (Outfall 030) limit I l

for fecal coliform was exceeded. These exceedances were due primarily to insufficient analysis of the potential adverse effects of a more restrictive limitation being placed on the use of chlorine for Outfall 030 under the new SPDES Permit (EDP 12/1/94) thus reducing the ability to disinfect the Outfall 030 effluent. A permit modification request was submitted 4

to NYSDEC and subsequently approved (June 19,1995) to allow for the use of a j dechlorination agent and related modification to the Sewage Treatment Plant. This permit modification should minimize fecal coliform exceedance in the future.

Copies of the comment pages and " Report of Non-Compliance Event" forms sent monthly to the NYSDEC, detailing the permit non-compliances as well as other pertinent comments, are

attached.

The existing SPDES Discharge Permit became effective on December 1,1994. As mentioned above, the Permit was modified by the NYSDEC on June 19,1995 and Niagara Mohawk notified the Commission of this modification, by letter, on July 18, 1995.

Niagara Mohawk will continue to keep the NRC staff informed of any changes in the NPDES /SPDES Discharge Permit or of any permit non-compliances. Such information will be supplied on a semi-annual basis.
