Dear Mr. Beaty:

This leteer is in response to your letter dated August 15, 1995 concerning the toxicity test failure which occurred for outfall 002 on June 7,1995. The permit condition Part III. A.13.

c. (Copy Attached) which required that a Toxicity Reduction Evaluation (TRE) be performed following a toxicity failure was dropped from the NPDES permit when Pha<e II went into effect on May 1,1994. This issue was also-discussed with Mr. Tim Eleazer who indicated that we do not need to perform the TRE analysis.

Additionally, please find attached a follow up toxicity test which was collected on June 22, i 1995 for outfall 002 following the June 7,1995 test. This follow up test passed the toxicity I

test. Please accept this passing follow up test in lieu of the Toxicity Reduction Evaluation.

A. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS

1. During the period beginning on (See Part III, Special Condition #14)of this Permit and lasting through the expiration date the Permittee is authorized to discharge from outfall(s) serial number (s) 002: low volume wastes, miscellaneous dilute wastewater, and metal cleaning wastes to Lake Wylie.

Such discharge shall be limited and monitored by the permittee as specified below:

2. Due to the intermittent and variable duration of the batch discharges for Outfall 002, the sampiing protoccl for chronic testing is modif,ed to allow Duke Power Company to conduct the chronic testing with only cne or two samples in instances when flow is not available.
3. Samples taken in compliance with the monitoring requirements specified above shall be taken at the fellcwing location (s): at the point of discharge from the conventional waste treat, gent (WC) system but prior to mixidg yy; with the receiving waters. f gj5
