in a rulir.g on September 29, 1983 the ASLB rewrote and allowed contention 11 i

and allowed rewritten contention 7.

Discovery on contentions 11 and 7 as weII as all other Emergency Planning Contentions, which were previously transmitted to you, is open from now until February 1,1984. Hearings are now expected to i

begin in early March. We are enclosing for your information a copy of the September 29 rullng and our maps and tables pertinant to population and i

population density in the northeast quadrant.

Confirming our telephone conversation of October 28, 1983 with Walter Kulash we are advised that our legal staff has discussed some of the discovery items i

with the intervenors. Therefore, we are requesting copies of the followl.ng information for review by our legal staff:

With reference to our proposal for Evacuation Time Estimate Analysis dated May 15, 1981 and addendum dated November 18, 1982, we are submitting hera-with our consulting fee schedule by staff category for additional services l

in connection with the referenced project (See Attachment A).

It is enticipated that such additional services may comprise the following:

1.

Review of interrogatories and development of responses relative to the evacuation time estimates for the Catawba Station.

2.

Conduct reviews of contentions relative to the evacuation time estimates and develop clarification and amplification as directed by Duke Power Company.

I Conduct special analysis of issues raised in any contentions 3.

relative to evacuation feasibility as directed by Duke Power Company.

Make depositions and attend hearings as required by Duke Power 4.

Hager August 15, 1983 Page~2 It is intended that PRC Voorhees will, of course, assign the staff members that have developed the time estimate report and that have familiarity with the site specific circumstances. In view of the difficulty in defining precisely the required level of effort, it is proposed that PRC Voorhees provides technical assistance on a time and material basis, with hourly rates for professional staff as noted in Attachment A.

Fees will be billed monthly and payable in 30 days. Direct costs, such as travel and per diem, will be billed at cost plus 10 pertent handling.

Please advise us of the acceptability of the above arrangement.
