APPLICATION FOR AMENDMENT TO OPERATING LICENSE Pursuant to Section 50.90 of the regulations of the Nuclear Regulatory Commission, Niagara Mohawk Power Corporation, holder of Facility Operating License No. NPF-69 hereby requests that Technical Specification 3.6.1.7, Primary Containment Purae System, set forth in Appendix A to the license be amended. These proposed changes have been reviewed in accordance with Section 6.5 of the Technical Specifications.

The proposed Technical Specification changes contained herein increase the time the 12-inch and 14-inch containment purge system supply and exhaust valves may be open in OPERATIONAL CONDITION 1,2 and 3, from 90 hours0.00104 days <br />0.025 hours <br />1.488095e-4 weeks <br />3.4245e-5 months <br /> per 365 days to 135 hours0.00156 days <br />0.0375 hours <br />2.232143e-4 weeks <br />5.13675e-5 months <br /> per 365 days, and delete expired footnotes for editorial clarity. The proposed changes would allow personnel access inside primary containment for system inspections under hot, pressurized conditions during restart from the September,1995 planned outage. Inability to perform these inspections due to the present 90 hour0.00104 days <br />0.025 hours <br />1.488095e-4 weeks <br />3.4245e-5 months <br /> time restriction would prohibit Niagara Mohawk's ability to detect and correct leakage from hot, pressurized systems inside primary containment, and evaluate the effectiveness of the corrective maintenance on the recirculation flow control valve position monitoring instrumentation prior to resumption of normal power operation, thereby increasing the potential for thermal cycling of the reactor vessel and forced unit shutdown. The proposed amendment will not authorize any change in the types of effluents or in the authorized power level of the facility. Supporting information and an analysis which demonstrates that the proposed changes involve no significant hazards consideration pursuant to 10CFR50.92, are included as Attachment B.

Pursuant to 10 CFR 50.91(a)(5), Niagara Mohawk requests that this Application be considered an emergency situation and that the Nuclear Regulatory Commission issue the requested license amendment without prior notice or opportunity for a hearing or public comment. Information contained in Attachment C supports this request. Attachment D presents the environmental considerations for the proposed Technical Specification change and concludes that no environmental impact statement or environmental assessment need be prepared, as there are no adverse environmental consequences associated with the proposed change.

Wherefore, the Applicant respectfully requests that Appendix A to Facility Operating License No.

NPF-69 be amended in the form attached hereto as Attachment A.
