s%[nchic11 A Q Mike Rogers being first duly sworn, deposes and says:

1) My name is Mike Rogers.

2) I am employed by Duke Power Company in the Construction Department at the Catawba Nuclear Station, in York, South Carolina as a Powerhouse Mechanic.

3) On 11/1i/81, I was checking some drawings in RB #1 when Jack Fox came up and told Powe. house Mechanic Foreman, Ed McKenzie, about Larry Johnson, Q.A. Inspector, not being satisfied with the red markings on his grinding disc. Shortly thereaf ter, Jackson walked up and told McKenzie ,

"They are all acting like a bunch of pricks down there." McKenzie then<

( said," You're just being an ass about the whole thing." Jackson said, V

"I don't know what lies they told you, but I know what happened." McKenzie said, "If you have to write it up, go ahead and do it. Let me have the disc."

Jackson gave the disc to McKenzie, and then asked to have it back.

McKenzie said it was issued to him. Ed asked the reason for the write up.

Jackson told him because of the violation of cpl 70. After more discussion, I saw Jackson pointing at McKenzie's chest. I was standing at an angle and couldn't tell if contact was actually made. However, I did see McKenzie's shirt moving. McKenzie told Jackson that he would deck him out if he didn't stop. McKenzie then apologized to Jackson and said he was sorry about the whole thing. Ed said he wanted to work the problem out.

Jackson insisted that he was going to get something done.

in my opinion, McKenzie was provoked by Jackson.
