cv ro Ronnie Martin, bel'ng first duly sworn, deposes and says:

1) My name is Ronnie Martin; 3

I am employed by Duke Power Company in the Construction Department the Catawba Nuclear Station as a Powerhouse. Mechanic.

3) On 11-11-81 I was in RB! I checking drawings in Ed McKenzie's work area.

Jack Fox was there telling McKenzie that he was going to be wrltten up by Larry Jackson.

Jackson walked up and informed McKenzie that he was writ ing Fox up for viola-tion of CP 170.

Both men argued back and forth about CP 170.

O Jack, son showed McKenzie the grinding disc Fox was using and said, "This ain't going to get it."

Jackson told McKenzie that the red marking on the disc was not sufficient.

McKenzie askhd Jackson to let him see the disc.

Jackson gave the disc to McKenzie and McKenzie placed the disc in his shirt pocket.

McKenzie told Jackson that the disc was his tool and it was issued to him.

Jackson then grabbed at McKenzie's pocket several times.

McKenzie brushed Jackson's hand away.

Jackson then began poking McKenzie in the chest while telling him that he would get' the disc.

.Ed McKenzie told Jackson, "If you put your hands on me again, I'm giong to Jack your jaws." Jackson took his glasses off and said, "I didn' t come down here to fight yoit."

McKenzie said, "I don't want to fight you either, but if you touch me again, I'm going to h

deck you."

McKenzie said, "I'm sorry about what happened.

You don't even need to talk to me."

Jackson said, "Those guys down there are acting like a bunch of pricks." McKenzie

said, "you're the one acting like an asshole." Jackson then told McKenzie he was trying to impress the crowd.

McKenzie said he wasn't and he told everyone to leave the area.
