Dear Comissioners:
As a supplement to the May 3,1984 petition of the San Luis Obispo, California Mothers for Peace under 10 C.F.R. 2.206, the enclosed affidavit notifies you of a development within the NRC staff responsible for the Diablo Canyon licensin'g decision -- the resignation of inspector Isa Yin from the review team overseeing the plant's readiness for commercial operation. Mr. Yin's resignation, and his reasons, have the most serious implications for -- (1) the safety of the plant; (2) the integrity of the record from the Independent Design Verification Program (IDVP), as well as of Pacific Gas and Electric; and, most significantly, (3) the integrity of the current NRC staff review.
Due to the former two reasons, I am forwarding the affidavit to the attorneys for the Mothers for Peace in relateo licensing proceedings.
Due to the latter reason, I am also forwarding the affidavit to the Office of Inspector and Auditor to add to its current investiga-tion of 16 alleged false and/or misleading statements on Diablo Canyon by the NRC staff.
The delay between GAP's June 25 notice of the problem and submission of this affidavit is due to our efforts to foster Mr. Yin's return.
On our own initiative, Ms. Billie Garde end I attempted to convince Messrs. Denton, Dircks and Vollmer to provide Mr. Yin the organizational freedom to do his job --
namely, by letting him see the evidence and interview the whistleblowers. We took this approach, because our goal is to see that Diablo Canyon is safe rather than to attack the NRC.
Unfortunately, we failed.
This letter will be further supplemented next week with additional evidence in support of the Mothers' petition. We had hoped to present much of the evidence j
to Mr. Yin and his colleagues, but will organize it into a written record until good faith is restored to the NRC staff's program at Diablo Canyon.
