) OL Clarification of Joint Intervenors' Position re Dr. John Gorman The Board's recent order means that Dr. Gorman will not appear in 1

this case, we believe. Still, we want to clarify on the record that. we did contact Dr. Gofman's place of work and confirmed that he is absolutely unwilling to appear as an intervenor witness. While we believe Dr.

Gofman's book Radiation and Human Health reflects excellent preparation, and we are sure he could defend it well, willing or unwilling, a different concern prompted our decision not to try to subpoena Dr. Gofman.

This is a difficult situation for us because a genuine rnterial issue '

of very imnortant facts (i.e. how serious are radiation health effects --

the deaths, cancers, genetic diseases etc caused by nuclear radiation) exists, yet we cannot get the best witness on the issue for us (Gofman).

ogg Be cause this issue is so important and our resources are so small, we run.

L But in consideration of Dr. Gofman's right to determine how he uses

We do, of course, reserve the right to subpoena nuclear industry witnesses who are voluntarily associated with the nuclear business. @2y

2 We are sending Dr. Gofman a copy of this clarification, and a copy I of the relevant portions of the March 8 corrected transcript of the conference call with the Board and parties, and of the relevant portions of the Board's most recent Order (dated March 15) concerning Dr. Gofnan.

We wish to emphasize our deen respect and gratitude for the work Dr. Gofman has done, and we wish hin all the best in his further endeavors.
