Subj ect: License Amendment Application to Revise Technical Specification 3/4.7.5.1, Ultimate Heat Sink Ladies and Gentlemen:

Enclosed is an application for an amendment to the Davis-Besse Nuclear Power Station (DBNPS), Unit 1 Operating License Number NPF-3, Appendix A, Technical Specifications (TS), to reflect the change attached. The proposed '

change involves TS 3/4.7.5.1, Ultimate Heat Sink, which presently requires that the ultimate heat sink (UHS) average water temperature be < 85'F during plant Operating Modes 1 through 4. The proposed change vould allow plant operation in these Modes with an UHS average water temperature < 90*F for a temporary period of 30 days.

A related letter was submitted by Toledo Edison (TE) on August 17, 1995 (TE Serial Number 2318), requesting enforcement discretion from TS 3/4.7.5.1 to allow continued plant operation in the event ultimate heat sink (UHS) average water temperature exceeds the current limit of 85'F. As also requested in the August 17 letter, in the event the UHS average water temperature exceeds 85'F, the enforcement discretion, if granted, vould be effective for only 30 days.

Toledo Edison requests that the enclosed license amendment application be approved and issued as an emergency license amendment in the manner' allowed  :

by 10 CFR 50.91(a).

Toledo Edison has performed the attached environmental assessment and determined that the proposed amendment, if approved by the NRC, vill have no significant impact on.the environment or irreversible environmental i consequences.
