Dear Judge Bloch:
This will confirm my telephone call to you yesterday.
Toward the end of the week of February 20 my firm and the law firm of Vinson & Elkins were retained by Brown & Root to provide counsel to certain Brown & Root employees, if they wish such counsel, in connection with the investigation requested by the Licensing Board of the Cygna matter in the above captioned proceeding.
After being advised that the Licensing Board requested a limitation on contacts between Applicant and Mr. Hutchinson in connection with the Cygna matter pending the completion of the requested investigation, Mr. Hutchinson requested Brown & Root that counsel be provided to him.
In response, Brown & Root offered the services of Mr. Carl Jordan of Vinson & Elkins and the undersigned.
Mr. Jordan and I advised Mr. Hutchinson that he was free to discuss any matters he wishes with the NRC investigators 91 O

make us available to represent him during the course of the investigation.
We advised him that we were also counsel to Brown & Root.
Based on our preliminary interviews with Mr. Hutchincon, Mr. Jordan and I satisfied ourselves that there was no apparent conflict of interest in our dual re-presentation of Brown & Root and Mr. Hutchinson.
Mr.
Hutchinson determined that he did want us to appear with him on his behalf during the course of the interview with NRC investigators.
Mr. Jordan met with Mr. Hutchinson on Friday, February 24 and he and I both met with Mr. Hutchinson prior to the commencement of the NRC investigation on Monday af ternoon, February 27.
Mr. Jordan and I were both aware.of the Order which you issued on transcript pages 9915 and 9916.
After it was made available to me on Sunday, February 26, I called Mr. Reynolds who advised me that it was his understanding that your-proscription was addressed to contacts between Mr. Hutchinson and the Applicant and would not apply to contacts between Mr. Hutchinson and counsel provided to represent him personally, notwithstanding counsel's representation of Brown & Root.
Based on Mr. Reynolds' understanding and my own reading of the transcript I was satisfied that our re-presentation of Mr. Hutchinson would not*be inconsistent with the intent of your order.
I showed the transcript pages of your order to Mr. Jordan on Monday morning, February 27 and he agreed with our understanding of the order.
I am writing these matters in response to the statements on transcript pages 10,374 and 10,375 where you indicated during I
a telephone conference call on February 28 that you had re-quested clarification from counsel for Brown & Root of our contacts with Mr. Hutchinson.
Prior to seeing this trans-cript yesterday morning, I had no knowledge of this request.
Both Brown & Roat and Mr. Hutchinson are committed to cooperating with the Licensing Board in the course of its review of the Comanche Peak licensing application, and particularly in the investigation that it has requested.
