The Township of Lacey has adopted the attached Ordinance which pertains to the retura, for storage, of spent nuclear fuel. 1.t is out position that the Cyster Creek site was not originally intended as a nuclear was.te storage area.

This is a Nuctcar Plant that ha.s the best operational record of ant) plant in the U,tited States. Lacey Township has had a very good relationship with Jersej Centtat. Power S Light and GPU Nuclear, the operators of the plant.

Mcw because of this new court order requiring the removat of the nuclear waste from its site in New York State, our relationship is becoming s. trained.

k'e met with officials of the GPU Nuclear on Thursdat j, Februa'ty 16, 1984 to discuss atternatives ta the return of the nuetear waste. It was pointed out at th:it meeting .that the Federal Government was not taking any steps to previde pnopeA places for waste sto'tage and that GPU Nuclear was being forced to bring the wtste back .to Oyster Creek becattse .there are no other approved places fan these materlats.

Thehe is a great deal at stake for both GPU Nuclear and the citizens of Lacet) Tcwnship and toe feet .that a great portion of the problem Lies wLth the NRC and the Federal regulations pertaining to the Nuclear Industry. These Nuclear Plants have been in operation for over 20 years andj t et .there is still no long range plan for .the reclaiming and disposat of spent nuclear fuel.

The Township Committee is requesting that an appropria.te member of the Nuclear Regulatortj Commission be sent here to Lacey Township .to meet with us to discuss this problem. Our regular meetings nights are Thursdays. However, we would be witting to meet with someone from tjour agencij on any night which would be appropriate if we are given a minimum of one (1) week's notice. Time is of .the essence, so a prompt response would be greatttj appreciated.

ORDINANCE AN ORDINANCE OF THE TO7NSHIP OF LACEY, COUNTY OF OCEAN, STATE OF NEU JERSEY, PROHIBITING THE IMPORTATION OF SPENT NUCLEAR FUEL OR RADIOACTIVE WA5TE FOR STORACE WITHIN THE TOWNSHIP OF LACEY, AND REGUI.ATING THE STORAGE OF SPENT NUCLEAR FUEL AND OR RADIOACTIVE WASTE AT THE OYSTER CREEK NUCLEAR POWER PLANT WITHIN THE TOWN 5 HIP OF LACEY /

BE IT ORDAINED by the Township Committee of the Township of Lacey, county of Ocean, State of New Jersey, as fo!!ows:

SECTION f. No persons shall import, transport or bring into the

. Township of Lacey any spent nuclear fuel or other radioactive waste for the purpose of storing the same within the Township of Lacey.

SECTION 2. No spent nuclear fuel er other radioactive waste, other than that genet ated at the Oyster Creek Nuclear Power Plant located witten th'e Township of Lacey, shall be held for storage within the Township of Lacey. In regard to the Oyster Creek Nuclear Power Plant, no spent nuclear fuel or radioactive waste produced by that p! ant, which has been removed from the Township of Lacey, shallbe brought back into the Township of Lacey for the purpose of stering the same on a temporary or permanent basis.

SECTION 3. Nothing in this ordinance shall be construed to prohibit the transportation ci spent nuclear fuel or radioactive waste through the Township of Lacey as authorized and sanctioned by the Federal Government and State of New Jersey.

SECTION 4. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.

SECTION 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by a Court-of competent jurisdiction, such portion shall be deemed a separate, distinct and.
