Mr. Eddleman arguG3 that the decision of the United States Court of Appeals for the District of Columbia in New England Coalition on Nuclear Pol ~ution v. N.R.C., No. 82-1481 (D.C. Cir. Feb. 7, 1 .

i 1984) overturns the regulation upon which the Eoard relied in rejecting Contention 58(2d). As Applicants demonstrate below, the " financial qualifications rule" at 10 C.F.R. S 2.104 (c) (4) remains in effect and Mr. Fddleman's Motion must be denied.
