APPLICATION FOR AMENDMENT TO OPERATING LICENSE Pursuant to Section 50.90 of tho rogulations of the Nuclear Regulatory Commission, tho Now York Power Authority, as holdor of Facility Operating Licenso No. DPR 59, hotoby applios for an Amendment to tho Tochnical Specifications containod in Appendix A of this licenso.

This application for an amendmont to the James A FitzPatrick Technical Specifications is boing submitted on an oxigent basis in accordanco with 10 CFR 50.91(a)(6).

At an August 2,1991 mooting with tho NRC's Rogion i staff, the Now York Power Authority committed to completo a full baselino barrior soal Inspection tiot lator than 30 .

days after startup from the 1993 refuel outago (Referenco 1), As a baselino inspection, this inspection usos Inspoation requiromonts more dotallod than previously employod at FitzPatrick and now acceptanco critoria. The first firo barrior ponotration soal was inspected on November 8,1991.

As of Docomber 18,1991, approximately 1812 ponotrations at FitzPatrick havo boon inspected under this progrant. This represents approximately 20 porcont of tho approximately 7,000 ponotration seals at FitzPatrick. Engincoring ovaluations have boon completod for 1617 of the ponotrations inspectod. Ono thousand, ono hundred and forty six of thoso moot the now acceptanco critoria. Ono hundred and fifty fivo of thoso penetrations did not moot the now acceptanco critoria but not to tho extont that they woro declarod inoperable. Throo hundtod sixtcon of thoso ponotrations did not moot the now acceptanco critoria and woro declarod inoporablo. This represents a significantly higher failuro rato than anticipated by the Authority.

Technical Specification 3.12.F,1.b requires that tho Authority post within ono hour a continuous firo watch at each f!ro barrior where a ponotration soal has boon declared non functional. Approximately twenty olght firo watches are currently in placo.

As moro firo barrior ponotration seals are declarod non functional, adoitional personnot will bo toquirod to stand cont!nuous firo watch. Bocause some of thoso ponotrations aro in radiation and high radiation areas, the posting of continuous firo watches (as opposed to hourly roving patrols) would incur unnocessary personnel exposures. This is poor practico from an ALARA standpoint. The use of roving firo patrols would provido an estimated reduction in personnel exposuro of approximately 20 man roms.

Tho proposed chango to the Technical Specifications is Attachmont I to this Applicat for Amendment to tho Operating Uconso. The Safety Evalvetion for the proposed chango is included as Attachment 11.
