Environmental Study Group hereby apply for the issuance of subpoenas requiring the attendance and testimony of witnesses and

the production of evidence at the adjudicatory hearings now 1

scheduled to commence on May 1, 1984, at Rock Hill, South Carolina, on the subject of emergency planning for the Catawba i

Nuclear Station and with regard to the contentions of Palmetto

and CESG which have been admitted for litigation.

Palmetto and CESG seek the issuance of subpoenas for the

1 attendance, testimony and production of evidence by the persons

-identified on the attached schedule who are believed to have knowledge of evidence relevant to the claims or defenses of Intervenors,, Applicants, or the NRC Staff because of their

'7s capacity and experience regarding the subject matter. 'Most of V

these persons are either state and local officials responsible r

in their official capacity for emergency planning, preparedness or protective action with respect to the Catawba facility, employees or agents of Applicants with similar responsibilities, or are other persons with knowledge or in control of evidence, relevant to the subject matter as indicated.

The general relevance of the evidence sought is reflected by the position or capacity of the persons as identified.

Palmetto and CESG will make such further showings of general relevance as may be required by the Board.

For each person indicated the subpoena should command attendance and testimony as well as the production of the following documentary evidence:

Any and all documents of whatever description in your custody or subject to your control reflecting your knowledge of emergency preparedness for the Catawba Nuclear Station, particularly including, but not limited to documents identified by you or your organization, agency or employer in connection with pre-hearing discovery requests in the NRC licensing proceeding for the Catawba facility.

Palmetta and CESG ask that the subpoenas be issued with the date and time of compliance in blank subject to specification by Intervenors prior to service based upon the hearing schedule as it becomes known; or, alternately, with the hearing commencement time and date set out so that Intervenors may specify a particularized time for appearance by letter or other 1

communication.

We ask that such subpoenas be issued on behalf of the Commission and served by registered mail pursuant to 10CFR2.720(c), if possible; but agree to provide for service and tendering of fees for attendance in advance if necessary.
