WRITER S DeRECT OtAL NuMeER November 30, 1983 822-1090 Mr. Wells Eddleman 718-A Iredell Street Durham, North Carolina 27705 In the Matter of Carolina Power & Light Company and North Carolina Eastern Municipal Power Agency (Shearon Harris Nuclear Power Plant, Units 1 and 2)

Docket Nos. 50-400 and 50-401 OL

Dear Wells:

On November 11, 1983, in response to' earlier rulings by the Atomic Safety and Licensing Board, Applicants answered your interrogatories 65-2 (a), 65-3 (a) and 65-3(b) (as modified in part by the Board), to which Applicants previously had objected as irrelevant.

Those interrogatories seek informa-tion with respect to concrete placements in containment buildings at the Wolf Creek, Callaway and Farley nuclear power plants.

Applicants stated that they did not know the answers to the interrogatories.

It was further explained that Applicants' contractor Daniel, which is not a party to i

this proceeding, has advised CP&L that any information available to Daniel with respect to these other nuclear projects which would be responsive to the interrogatories is not within the control of CP&L as that term is construed for discovery purposes.

e SHAw, PITTMANs PoTTs & TROWBRIDGE A PART9eteSMep OP pmOPtesecte&L COmpomanOses Mr. Wells Eddleman November 30, 1983 Page Two Consequently, Applicants did not respond explicitly to i

Judge Kelley's statement that, with respect to the portion of Interrogatory 65-3 (b) not included in the Board's rephrasing, Applicants should identify a person knowledgeable in this area and make him available for deposition.

See Tr. 687.

Since Applicants have no information in response to the Board's rephrased Interrogatory 65-3 (b), we thought it apparent that none of Applicants' personnel are knowledgeable with respect to the remainder of the interrogatory.

In our telephone conversation of November 22, 1983, you

]

requested that I confirm the situation in writing; and it is the purpose of this letter to do so.

As we understand the remainder of Interrogatory 65-3 (b), it seeks, for significant repairs made to concrete in the base mats and containment l

walls at Wolf Creek, Callaway and Farley after discovery of significant defects, identification of:

(a) whether the defects were found by Daniel or others; (b) who found the defects; (c) when they were found; (d) when the concrete found defective was originally poured; (e) when repairs were begun; and (f) when repairs were completed..

i i

l This is to confirm that Applicants have no personnel knowledgeable on these subjects to produce for deposition.

Sincerely,

~
