By letters dated March 14 and 22,1995 (References a, b, and c) you informed us that you have denied our requests to withhold Combustion Engineering proprietary information from public disclosure. You had previously determined that this information met the requirements of 10 CFR 2.790 and had agreed to withhc!d the information marked proprietary from public disclosure. However, you informed us that your recent review of the matter led you to " conclude that although the information sought to be withheld from public disclosure meet [ ] the requirements of 10 CFR 2.790, the demonstrated competitive position [s] do[ ]
not outweigh the public's right to be fully apprised of the results of [our] engineering analyses." Therefore, you have decided to place the subject information in the public document room within 30 days from our 9504130360 950411 O

We consulted with Combustion Engineering regarding your decision, and they have agreed to release the proprietary information identified in the referenced letters. Therefore, we will not request withdrawal of the subject documents in accordance with 10 CFR 2.790(c). We have attached identical copics of the documents in question, with all the references to the proprietary nature of the documents removed, for placement in the public document room.
Should you have further questions regarding this matter, we will be pleased to discuss them with you.
