PALMETTO ALLIANCE'S ANSWER OPPOSING APPLICANTS' MOTION FOR STAY OF ORDERS ISSUED BY THE ATOMIC SAFETY AND LICENSING BOARD AND THE ATOMIC SAFETY AND LICENSING APPEAL BOARD Pursuant to 10 C.F.R. 2.788(d), Palmetto Alliance hereby opposes the Applicants' motion requesting a stay of orders of the Atomic Safety and Licensing Board and the Atomic Safety and Licensing Appeal Board. Applicants have failed to meet the stringent standards necessary for the granting of the extraor-dinary remedy of a stay, and accordingly their motion must be denied. l I. Introduction. One of the most crucial inquiries in the Catawba proceeding ! is the question of the quality of the welding at the plant. In discovery, Palmetto Alliance obtained documents from a large number of welding inspectors that revealed serious problems of pressure from Duke Power management to circumvent the official written QC procedures, and of retaliation by Duke Power manage-ne

 ,   witnesses before Palmetto Alliance designated, and subpoenaed, them as its witnesses, that only Duke Power has any right to talk to thes'e witness during breaks in the hearings and while the hearings are adjourned.

In response to a request from Palmetto Alliance, the Atomic Safety and Licensing Board, in an Order upheld with slight modifi-cations by the Atomic Safety and Licensing Board, held that Appli-cant could not order its employees, except for executive level employees, not to talk to counsel for Palmetto Alliance, and that "the witnesses may decide for themselves whether to cooperate with Palmetto." Order, November 10, 1983. The Appeal Board amended this Order to specify that Applicants could order their employees "not to disclose to Palmetto or its counsel during the course of any off-the-record contact any communication between the witnesses and Duke counsel bearing upon this licensing proceeding and the issues being litigated therein." Moreover, Palmetto Alliance was prohibited from inquiring of any such witness as to the existence of any such communication. Finally, the Appeal Board cited Upjohn l Co. v. United States, 449 U.S. 383, 395-96 (1981), for the proposi-tion that these restrictions did not apply to "any statement of underlying fact, whether or not that fact was communicated to

Duke counsel by the witness." Order, November 15, 1983.

Now Duke Power is urging the Commission to take interlocutory action to stay the effect of these Orders, so that it may bar any off-the-record contact between these crucial witnesses and Palmetto Alliance. II. Applicants fail to meet the requirements for a stay. The interlocutory issuance of a stay is an extraordinary remedy, one that requires an extraordinary showing by the moving party. The Commission recognizes this in its regulations, which

(e) In determining whether to grant or deny an application for a stay, the Commission ... will consider: (1) Whether the moving party has made a strong showing that it is likely to prevail on the merits; (2) Whether the party will be irreparably injured unless a stay is granted; (3) Whether the granting of a stay would harm other parties; and (4) Where the public interest lies. Applicants have not come anywhere close to satisfying these requirements, as is shown below, and accordingly their motion should be denied. A. Applicants fail to make a " strong showing" that they are likely to prevail on the merits. An essential requirement for the granting of a stay is a

    " strong showing" that the movant is likely to succeed on the merits. The Applicants' attempt at satisfying this crucial requirement is weak indeed, in essence consisting of no more than a blatant misreading of the Supreme Court's ruling in the Upjohn case, and the " red-herring" assertion that the rules of professional conduct somehow make any contact with an opponent's witnesses unethical. Neither of these assertions offers any support, much less strong support, for the ation that the Appli-cants are likely to prevail on the merits.

In fact, the weight of authority establishes exactly the opposite, that it is entirely proper for an attorney to talk to the witnesses for the opposition. This is clearly established by the annotations to the very Disciplinary Rule that the Applicant claims the Boards' Orders would cause to be violated, DR 7-104: The general rule with regard to an opponent's witnesses is that attorneys for one party in a pending case are free to I

 ,           also Reilly v. Keswani, 137 N.J. Super. 553, 350 A.2d 74, 76 (1975), in which the court held that DR 7-104(A)(1) had not been violated whwn the plaintiff's expert witness conferred with the the defendant without the plaintiff's attorney's prior authorication, consent or knowledge. Even if the witness is an employee of the defendant, it is ethical for the attorney for the claimant to interview the witness so long as he or she practices no deception and informs the witness that he or she is the attorney for the claimant.      (For-mal Opinion 117, August 27, 1934). However, if a prospective witness is also a party to the litigation, the rule applies,
t and the witness may not be interviewed unless the witnesses attorney either is present or gives conient. (Formil Opinion 187, July 24, 1938).

American Bar Foundation, Annotated Code of Prof (ssional Responsibi-(emphasis added) lity (1979)/. See also, Formal Opinion 127 (March 15, 1935) (Holding it is proper to interview a witness that had been subpoenaed by the other side); Informal Opinion 892 (October 11, 1965) (Holding it is proper to interview opposing parties' witnesses outside the presence of opposing counsel) . The rationale for this rule is clear: , Service of a subpoena on / a witness 7 by T one side 7 1 does not make him unapproachable by the attorney for the [~ other side 7, who must ascertain the truth and bring it out in the trial and to that end may properly interview witnesses subpoenaed by the other side, if no deception is practiced by him, in order that justice may be done. Formal Opinion 127, supra. (emphasis added) . Therefore, it is clear that justice, and the settled law, require that Palmetto Alliance counsel be allowed to talk to all of Duke's employee-witnesses who are not " parties" to the action. This exemption applies, at most, to those " executive-level witnesses" as to which the Licensing Board drew a distinction. As stated in the Annotated Code of Professional Responsibility, i supra, at 336: l [B_7ecause corporate and governmental entities probably have exclusive possession of information that is critical to the litigation of a s2se, statements of corporate employ-l ees may be essential to the opposing party. If the rule l [ DR 7-104]/ were construed to include all corporate employees as parties, the opposing party's ability to gather evidence , 1

                                        -5 would ba cignificcntly impaired. Thsrafora, the term " party" chsuld ba spplisd only to those exscutiva officers who can be hold parconally accountable for corporate conduct.

The court in FMC Corp., 430 F. Supp. 1108, 1110-11 (S.D.W. Va. 1977) took this position as well. The corporation contended that all of its current salaried employees and some of its former sal-aried employees were " parties" within the meaning of the rule. The court rejected this argument, and found that only a very few of the I most senior executives could be considered " parties" and therefore improper subjects for interviews by opposing counsel. Other authorities have not extended the meaning of the term

        " party" even that far. Thus, the court in H.D.S. Mercantile Corp.
v. Monet Fashions, Inc., 234 N.Y.S.2d 547, 549 (1962) held that the term " party" "cannot be extended to the officers, servants, agents and employees of the parties, whether such parties be cor-porations or natural persons." See also, Know the Facts, Inc. v.

Ryan, 137 A.2d 611, 613 (1958). Under either of these interpretations, it is clear that the l employees at issue here, the QC inspectors, are not " parties" to the litigation and therefore it is proper for counsel for Palmetto Alliance to talk with them without the presence, permission or knowledge of Applicants' counsel. Applicants try one 6ther argument in their attempt to bar Palmetto from talking with these important witnesses, which is to advance a mistaken reading of the Supreme Court's opinion in Upjohn v. United States, 449 U.S. 383 (1981). Applicants errone-ously claim that Upjohn's rejection of the " control group" test meant that all corporate employees could be prevented from talking to opposing counsel. Even a quick skim of the case itself, however, points to the fallacy of that argument, and clearly shows that even though certain communications may be subject to an attorney-client privilege, that does not prevent discussions about the underlying 1 l.

 ,           The / attorney-client [7 privilege only protects disclosure of communications; it does not prevent disclosure of the underlying facts by those who communicated with the attorney.

Upjohn, supra, at 383. Thus, the fact that any corporate employee who communicates with a corporate lawyer may have a privilege against divulging that communication, that fact does not in any way act to prevent that corporate employee from discussing the underlying facts with the attorney for the other side, if that employee chooses to do so. The Atomic Safety and Licensing Appeal Board correctly ap-plied Upjohn when it allowed Palmetto to question witnesses who are willing to cooperate, concerning underlying factual questions. The two purported contrary decisions cited by Applicant are easily distinguishable. One (Matter of Russell, 282 A.2d 42 (1971)) held it improper for one lawyer to advise a client of another lawyer in a fashion contrary to the advise given by the lawyer actually retained by the client. The giving of advice, rather than the inquiring as to facts, brings the conduct within DR 7-104(A)(2) . l The other (Matter of Mahoney, 437 N.E.2d 49 (1982)) held that it I was improper to disregard another attorney's wishes in talking to his client about matters affecting the client's vital interests 1 (in Mahoney, the witness' own trial for robbery). Neither of these cases affect the correctness of the Appeal Board's application of Upjohn. The only employees who might have " vital interests" at stake in this case are the top management, who could be personally liable for corporate actions. This analysis has so far tacitly assumed that the employees in question actually are clients of the attorneys for the corporation itself, and has shown that even if they were, they could properly talk to counsel for Palmetto. Beyond that, however, is the fact ,

that witnessas who appmar on Applicant's raquast do not thnrefore become " clients" of Applicants' counsel. Just as "the mere fact that a person appeared as a witness ... does not make him a party," ) Barnett v. Williams, 140 S.E.2d 466 (1965), so too a witness for one side "in no sense is [~that attorney'sj[/ client." Formal Opinion 12 (January 4,1928) . Moreover, if the counsel for the Applicant were to purport to enter into a fiduciary relationship with individual QC inspectors, they would be in violation of the code of professional responsibility. For example, Ethical Consideration (EC) 5-15 states that a lawyer representing clients with "potentially differing interests" raises the possibility of impaired judgment and divided loyalty, and instructs that the lawyer "should resolve all doubts against the propriety of the representation." Disciplinary Rule (DR) 5-105(B) states that except in certain very limited circumstances, a lawyer "shall not continue multiple employment" that is likely to impair his judgment ) or " involve him in representing different interests." < In the instant case, it is clear that the interests of the welding QC inspectors who raised concerns of circumventing proper prccedures and management harassment for bringing up concerns do not have been i have the same interests. If they did there would not /r the original complaints, management would not have harassed them, and three former Duke employees would not have felt obliged, as they did, to seek outside counsel, the Government Accountability Project, to represent them when they appeared in the Catawba hearings as Board witnesses. Further evidence of the divergence of interests between Duke and the welding QC inspectors is furnished by ATTACHMENT 1, " Testimony;of Gary E. Ross," filed in this case. Mr. Ross details the csnflicts of in-I terest between him and the company management. It is also revealing to note that Mr. Ross, on page 8 of his testimony, incorrectly cites

10 C.F.R. 50 as the provision under which he has been discriminated against, an unlikely error if he were actually being represented by a lawyer who had his interests foremost in his mind. Thus, it is doubtful that these witnesses, especially in the absence of any request from them to Applicants' counsel for representation, are Applicants' counsel's ' clients. Since, as shown above, the welding QC inspectors are not " parties," and even if " clients" of Applicants' counsel are still able to discuss factual matters with Palmetto if they choose, it is clear that the crucial need for a " strong showing" of likelihood of prevailing on the merits has not been met. B. Applicant will not be irreparably harmed if the stay is not granted. Applicant will not be irreparably harmed by being constrained to adhere to the settled law. As shown above, talking with witnesses about underlying facts does not violate any attorney-client privilege, nor will it violate any protection of attorney work-product to talk about the underlying facts in the case. Applicant does not have a "right to counsel" to require its presence when its employees are interviewed. If an individual witness chooses not to talk to Palmetto, or to do so only if Applicants' counsel is there, he is perfectly able to assert those rights within the terms of the Orders as written. C. The granting of a stay would harm other parties. The granting of the stay would harm Palmetto by placing it in a second-class status with respect to the witnesses called by both Duke and Palmetto and necessary for Palmetto's case. It would put Palmetto at a great disadvantage by allowing Duke to prepare and question these key witnesses prior to their testimony, while denying any role at all to Palmetto, which is equally interested in the testimony of these , witnesses can offer. In view of the settled law to the contrary, the 1

granting of a stay would greatly prejudice the fairness of the proceeding, harming Palmetto's ability to put on its case. D. The public interest favors denying the stay. The purpose of allowing an attorney to talk to the other side's witnesses is so he or she may " ascertain the truth and bring it out in the trial . . . in order that justice may be done." Formal Opinion 127 (March 15, 1935). The public interest is served by allowing the truth to come out, which will happen best iftboth sides are able to explore the basic facts with this group of key witnesses. To

 ..       obtain the beneficial effects of the sunshine of open inquiry, the stay should be denied.

III. Consideration of the Commission's specific questions. The specific questions posed by the Commission further reflect the above analysis, and lead to the conclusion that the stay should be denied.

Question 1: Is there an arlorney-client relationship between l Applicant's attorneys and its witnesses, and if so why?

l l Answer: If so, onl between Applicant'y to the extent s attorneys that specific and employees arecommunications exempt from disclosure. Because of the divergence of interests, Applicant's welding QC inspectors are not clients of Applicants' attorneys, especially in the absence ofsmy clear request by such employees i for any such representation. In any event,it is proper for Pal-l metto to question such employees. l Question 2: Are Applicant's witnesses "a" party" in the context of ABA Disciplinary Rule 7-104? Answer: As shown above, clearly not, at least as to the welding l QC inspectors about whom this controversy arose. Question 3: Does the validity of the Boards' orders depend upon whether the witnesses are " clients" or " parties"? i Answer: The validity of the orders does not depend on whether the witnesses are clients; regardless of that, it is proper to question them on underlying facts, as established by Upjohn. . The validity of the orders does depend on whether the witnesses l are parties, but they clearly are not, so the orders ar valid. l

Question 4: Are there circumstances under which Applicant's witnesses, who are also its employees, simultaneously can be Intervenor's witnesses? If so, are those circumstances present in this case, and what effect does this have on the validity of the Boards' orders? Answer 4: When, as here, certain witnesses have exclusive know-ledge of facts of crucial importance to both sides, it is fair to characterize them as the witnesses of both sides. Similarly, the Board brought some former Duke employees to testify as Board witnesses. The key factor is equal treatment of both sides, so as not to prejudice the chances of one side. However, the3 question whether witnesses can simultaneously appear for both sides is one that the Commission does not have to reach -- it is well-estab-lished, as noted above, that a party has the right to question the witnesses of the opponent without the presence, permission or even knowledge of the opponent's counsel. Therefore the Boards' orders are valid regardless of the answer to this question. As can be seen from the answers to the Commission's specific questions, as from a consideration of the factors of 10 C.F.R. 2.788(e), the requested stay should be denied. IV. Conclusion. For the reasons set out herein, Palmetto Alliance respectfully 1 requests the Commission to deny the Applicants' motion for a stay of the Boards' orders. WHAT OTHElt JOl) POSITIONS HAVE YOU HELD WITH DUKE POWER 3 COMPANY? . 4 A. 3 started as' a welder for Duke in 1971, then transferred into 5 belding inspection as an inspector in 1973. 6 Q. ARE YOU FAMILIAR WITH WHAT IS COhDIONLY REFERRED TO AS 7 THE WELDING INSPECTOR CONCERNS WHICH WERE EXPRESSED IN 8 LATE 1981/EARLY 1982? 9 A. Yes. 10 Q. WHAT IS YOUR UNDERSTANDING OF WHAT THESE CONCERNS 11 WERE? ,- 12 A. These concerns were instances where the inspector would find a 13 breach of the procedure and could not get support by QA 14 management to enforce the procedure. Also, one concern was being 15 verbally forced into signing off items which did not meet procedural 10 requirements. There was some concern about QA being swayed by 17 construction , and QA not standing up when inspectors were 18 harassed. 19 Q. DID YOU EXPRESS ANY CONCERNS TO ANY OF THE TASK 20 FORCES OR TO DUKE POWER MANAGEMENT? 21 A. Yes. 22 Q. TO WHOM DID YOU EXPRESS YOUR CONCERNS? 23 A. I talked to Charles Baldwin , Larry Davison , Warren Owen , Jim . 24 Wells , Task Force I, the Technical Task Force, the Non-Technical 25 Task Force, Gail Addis, Lew Zwissler, Bob Morgan, and Art Allum,. 26 and others representing Duke Power Company. 27 Q. WERE YOUR CONCERNS WRITTEN? 28 A. Yes. ~

The concerns I submitted to the Technical and Non-Technical Tar.k 4 Forces are contained in an eighteen page handwritten statement 5 which is attached to my Testimony as Attachment A. This included 6 all of the concerns I had at that time. Since then, I have had 7 additional concerns which are disucssed in documents noted in a 8 later question. These documents are attached to this testimony as 9 Attachment B. 10 Q. DID YOU FEEL FREE TO EXPRESS ALL OF YOUR CONCERNS? 11 A. No , I did not feel free to express all my concerns because of 12 possible retaliation and discrimination against me. The atmosphere 13 at times was very negative and very demoralizing. Everyone 14 seemed to be taking concerns very lightly. Attitudes toward me l i, had t.udalenly chany.cil. IG Q. DID YOU EX1'ItESS Al.L Ol' YOUlt CONCEltNS? 17 A. Yes, In spite of circumstances I did submit all my concerns. In 18 addition , despite this feeling of possible retaliation to the best of 19 my knosyledge all other inspectors also expressed all of their 20 concerns. 21 Q. HAVE YOU DISCUSSED YOUR CONCERNS WITH ANYONE ELSE? 22 A. Yes. I talked to Mr. Kim Van Doorn of the NRC during their 23 investigation . . 24 Q. DO5S THE DOCUMENT ATTACHED TO YOUR TESTIMONY AS 25 ATTACHMENT A REFLECT ALL OF YOUR CONCERNS? 26 A. No. The statement submi.ted to the Task Forces contained all of 27 the concerns I had at that time. I have additional concerns which 28 are set forth in documents attached to my Testimony as Attachment

I B. These are (1) my 1983 evaluation recourse submitted to . loc 2 Willis and L. R. Davison , (2) a June, 19S2 letter to Art Allum 3 requesting information on discrimination and retaliation recourse 4 p'rocedu res , and (3) copics of calendar pages containing recent i 5 tioncerns which were provided to Duke during discovery. These 6 documents ( Attachments A and B), taken together, reflect all my 7 concerns. 8 Q. PLEASE SUf@lARIZE AND EXPLAIN Wi!AT YOU WERE TRYING TO 9 CO>BlUNICATE BY YOUR CONCERNS. 10 A. I was trying to let Duke know that we were not following our QA 11 Program., I was wanting to get support for myself and the 12 inspectors, so we could properly enforce the program. I was 13 trying to tell Duke that we were not getting support due to our 14 management being overly lenient with construction. We were in fact h 15 being punir.hed, ley treatment and lay attitude, for trying to enforce 10 the QA Program. I want to be clear, with the one excep tion 17 dealing with grinding on the inside diameter of a pipe (discussed in 18 the Attachments and in later answers), my concerns did not 19 adversely affect safe construction of the plant. 20 Q. WERE YOUR CONCERNS INVESTIGATED BY THE TASK FORCES? 21 A. Yes. However, the task force appeared to be focusing totally on 22 determining whether concerns affected plant safety, instead of also 23 focusing on the failure to follow the QA program. In addition, 24 some concerns which were definite procedural violations were labeled 25 as non-procedural violations by the Technical Task Force. 26 Q. DID YOU ATTEND A'NY MEETINGS WITH TASK FORCE AND/OR QA 27 MANAGEMENT MEMBERS WHERE THE TASK FORCE FINDINGS, 28 CONCLUSIONS AND RECO>DIENDATIONS WERE DISCUSSED? _4

1 A. Yes. The meetings were held to inform the inspectors of the 4 2 findings, conclusions. and recommendations. Some recommendations 3 were aimed at the inspectors, while in my opinion, they should have 4 been nimed at const ruction . For example, instruction to inspectors 5 on their role in the job . This should have been given to 6 cons truction . 7 Q. WERE THERE ANY CHANGES MADE IN THE QA PROGRAM AFTER 8 THE WELDING INSPECTOR CONCERNS AND THE TASK FORCE 9 INVESTIGATION OF THESE CONCERNS? 10 A. Yes. 11 Q. DESCRIBE THE CHANGES OF WHICH YOU ARE AWARE IN THE QA 12 PROGRAF 4. 13 A. A lot of concerns have been incorporated or clarified in the 14 procedures. For example, non-conforming items are handled per f% ( 15 procedu re , process specificat ions. nre writ ten more clearly on 3.o n e IG it. sues, and process control information ir. now more fully specified. 17 Q. TO WHAT EXTENT liAVE TIIESE CIIANGES ADDRESSED ISSUES 18 RAISED BY Tile WELDING INSPECTOR CONCERNS AND TO Wil AT o 19 EXTENT IIAVE TilESE CIIANGES ADDRESSED YOUR PARTICULAR l 20 CONCERNS? 1-A. 21 In that I am not aware of all the other welding inspector's 22 concerns, I can not say to what extent they have all been resolved 23 by subsequent actions . However, all of the other inspector 24 concerns of which I am aware and all my concerns except one below) have been

25 (discussed adequately resolved by actions 26 including procedural changes, more ridged enforcement of 27 procedures, personnel changes, and introduction of a technical and 28 non-technical recourse procedure. The one concern that has not

1 b(en resolved to my satisfaction involves retaliation and (.- 2 discrimination against me personally , about which I filed a 3 non-technical recourse. . 4 Q. iHE WELDING INSPECTOR CONCERNS HAVE BEEN f 5 . CHARACTERIZED AS CONCERNS ABOUT THE QUALITY AND o SAFETY OF CONSTRUCTION AT CATAWBA. DO YOU AGREE OR 7 DISAGREE WITH THAT CHARACTERIZATION? 8 A. I mostly disagree with that characterization since most of the 9 concerns were dealing with procedures not being followed and 10 inspectors not being supported. However, tnere was one concern 11 which could have affected the quality and safety of the plant. This 12 concerned involved a root pass condition on the inside diameter of a 13 pipe which was ground with no ultrasonic testing performed to 14 determine the remaining wall thickness. To the best of my 15 knowledge , all of the conecrns .which I think could affect the 16 quality and safety of the plant were submitted by inspectors, 17 investigated and corrected. 18 Q. DID TIIE EXPRESSION OF YOUR CONCERNS INDICATE YOUR 19 BELIEF .THAT THERE WAS A BREAKDOWN IN THE QA PROGRAM 20 OR INDICATE THAT THE QA PROGRAM WAS NO LONGER 21 WORKING? l 22 A. With the exception of the one instance concerning grinding on the l l 23 inside diameter of a pipe (as noted above), my concerns do not _ 24 ( indicate a belief that there has been a breakdown of the QA 25 program as it relates to safety. However, I do believe that in a 26 procedural sense there was some breakdown in the program. The 27 QA program is based on the procedures being followed, and any 28 deviations from procedures should be handled in accordance with l l l 1 provisions established by the program. This did not happen. The 2 program was verbally deviated from and the inspection personnel.  ! l 3 including myself, were subject eil to scheilule prenr.u re and i 4 intimidation by QA Management to the point that I felt relu'ctant to l 5 press myself fully. G Q. DID YOUlt CONCEltNS REFLECT A BELIEF ON YOUR PART THAT 7 THE CATAWBA PROJECT IS NOT BEING CONSTRUCTED SAFELY?

8 A. For the most part, no. However, there was one issue previously 9 discussed regarding grinding on the inside diameter of a pipe which 10 could have affected safe construction . To the best of my 11 knowledge this issue was investigated and corrected. 12 Q. IN YOUR VIEW, HAS THE QA PROGRAM BEEN EFFECTIVE WHILE 13 YOU HAVE WORKED AT CATAWBA? 14 A. To a large degree yes, but not as effective as it should have been 15 due to lack of support for myself and other QA inspection 16 personnel. The program would have been more effective had our 17 management been less inclined to give in to construction pressure 18 and more inclined to listen to the people who were working for them 19 in the field. However, despite this lack of effectiveness in some 20 parts of the program, I believe that the safety of the plant has not 21 been compromised. 22 Q. ARE YOU AWARE OF ANY DEFICIENCIES IN CONSTRUCTION OR IN 23 THE QA PROGRAM WHICH WOULD CAUSE YOU TO QUESTION 24 WHETHER CATAWBA IS SAFELY BUILT? 25 A. No. 26 Q. IS THERE ANYTHING ELSE YOU WOULD LIKE TO ADD TO YOUR 27 TESTIMONY? s 1 A. I feel that Caiawba will bc .afe to operate. I a h,o feel that 1, 2 along with most inspection personnel who submitted concerns, have 3 been adversely affected by this submitting of concerns in terms of 4 tr'eatment, promotion potential, or transfer potential. I know in my i . 5 diyn case, I have been treated very badly on my evaluations and 6 pay raises . I have received very negative treatment from Joe 7 Willis, Art Allum, and I feel to a degree from L. R. Davison, in the 8 sense of no help on my recourse. I feel I have been discriminated 9 against in violation of 10CFR50 in that my conditions of employment 10 and compensation for employment have been adversely affected by 11 my expressing my concerns of no support from QA management and 12 their not following procedure. I only submitted concerns because I 13 felt we were living a lie, saying one thing in our manual but in 14 reality doing something else. It should be noted that our QA "t' 15 procedures had standards well above industry codes and standards. 16 When we deviated from our standards we never dropped below those 17 industry standards. liowever, we failed to follow our own QA 18 program, for example, when we did deviate. I submitted concerns 19 for the b.cnefit of Duke Power Company, and not for the benefit of l 20 Gary Ross. I submitted concerns knowing that management would i 21 probably be miffed at me and I would be blackballed. But being a 22 God-fearing Christian, I had to submit concerns out of honesty. 23 All of my concerns were no surprise to management because on each ' i 24 concern I had already presented it to my supervisor when it arose 25 in order to prevent it from being a problem. But as usually was 26 the case, my supervision listened to construction and not to me, 27 therefore my only alternative was to document what happened for l o

1 1 fut ure reference. I got tired of fighting for the program abnust 2 daily . 3 I have tried to get under new management by applying for  ; 4 t[ansfer but have not been allowed to transfer. I have seen some 6 5 Ositions filled that I would like to have had, but no luck. I feel 6 that I am going to be kept on construction and not transferred to 7 nuclear production until there is no place to go and then I will 8 probably be laid off. I feel this is because of my being vocal on 9 no support and this will be my punishment for being too concerned. 10 At the present time, things seems to be going pretty much as 11 they sho.uld. I have more hope than I have had for sometime. I 12 do hope that all the harassment, intimidation, and negative 13 treatment I have been subjected to is over but, due to scars I have g 14 from being treated so shabbily and discriminatorily, it makes it k- 15 hard to believe that I have seen the last of it. The sad part is all 16 the pain, mental anguish, discrimination, retaliation, defamation of 17 character that I have been subjected to comes because of my trying 18 to help Duke live up to its word, the QA Program. 4 O _g.

                 .Re:   Catawba 1-2 Employee Recour.se in accordance with our Department Management Procedure 8901-0012-QA-001 This is in response to your letter dated April 18, 1983 As you recall we agreed to extend the time for response to Friday April 22, 1983.

After discussions with you and A E Allum which were held seperately I

       .         do not feel that you have been discriminated or retaliated against based on your performance review for this year or last year. The Performance Management Program requires a distribution of Performance
   .             Evaluations such that there will be scme people rated betw average, some average and some above average.      This distribution may occur naturally or l't may occur by a relative comparison of performance against a performance profile. There are several people at our location whose performance was evaluated and determined to be below average because expectations were not met. The accountability sumary and appraisal form (ASCA) Identifies these areas with a brief explanation of the rating. There are some areas in which other people were given the same rating you received for basically the same reason.      Specific examples given are not necessary Intended to be all inclusive but indicate

! areas where additional improvement is needed. Your apprasial form also I Indicates your performance has improved during this past revie.w period. Based on my discussions with you and Art i feel there are some misunder-standings that need to be Identified and resolved concerning your evaluation. To this end I am directing Art Allum to go over the evaluation with you again. Some disagreement is expected as Indicated by the note to the e.:ployee in the blocis containing your signature which says your signature does not necessarily indicate you agree with the evaluation. Art held a review in January concerning your performance and there will - l be reviews at approximate three month intervals during this current l review period. Hopefully this will eliminate any surprises at the end l of the review period. As stated in the QA Department employee recourse procedure, it is the policy of Duke Power Company that ergloyees should be able to express their concerns without fear or retalliation. This procedure along with the department's quality recourse procedure provide avenues for employees to express their concerns to sucessively higher levels of management until they are resolved. This process itself would mean that any supervisor or marugen.ent person would have nothing to gain by threatening, intimidating

O or retallating against an employee for expressing their concern. I can assure you that you should not feel threaten or intimidated bicause of expressing your concerns,- and, that this recourse will not be used againsy you. You are free, as all employees are, to follow these procedures when you have concerns until you are satisfied or the concern has bee'n ruled on by the highest level the procedure allows. If you do not feel this response satisfactorily addresses your concern you should address them to the next management level, the Project QA Manager, L R Davison, in accordance with the recourse procedure.

In looking into your recourse I have talked with both you and Art Allum, I have reviewed the performance appraisal of other supervisors in positions similiar to yours; and, I have spent a great deal of time reviewing your own appraisal. I can understand how one would feel upon learning that his or her perfor.7.ar. appraisal was rated lower than expected. I can understand how thic could make you feel as if you had not been dealt with fairly. I have thc.;ughly investigated your appraisal and your concerns about being discriminated jetg

against. Whereas your feelings are important to me, out of fairness and equity each performance appraisal must be evaluated on its true merits. This has been my approach in my investigation into this matter. In short, my decision is that jour appraisal conducted this past April is proper. I think your feelings about this appraisal stem largely from two items. , The first item is the fact that our expectations of you in your position were not communi.cated to you clearly enough nor in enough detail. This lack of good communications I accept the responsibility for. I am taking steps to see that it does not occur again. But, even with this problem, a clear improvement in your performance is noted on your appraisal. I see no reason why that should not continue and even get better with improved communication on our part. I ask tS:t 'fou also recognize the importance of your communicating clearly with your supervisor. If directions or decisions are of concern to you - be sure you have used all the proper channels to communicate and resolve them. The second item which I concluded had contributed to your feelings of being discriminated against is your interpretation of certain actions, or inactic: by Art Allum. My investigation revealed that in these cases you were not ( aware of all that had taken place and; therefore, you viewed them as discriminatory against you, or in favor of someone else.
