Dear Sir:

Pursuant to the Freedom of Information Act, 5 U.S.C.

S552, as amended, and 10 CFR Part 9, the Department of the Attorney General of the Commonwealth of Massachusetts requests the following documents relative to the Seabrook Nuclear Powar Station in Seabrook, New Hampshire.

DEFINITIONS (1) The term " document (s)" refers to the original and copy (but not both if identical in every respect) of any printed, written, recorded, transcribed, punched, taped, filmed, photographed or graphic matter in the possession or subject to the control of the NRC or any Commissioner, employee, agent or attorney thereof, whether sent or received or neither, whether a draf t or otherwise, however produced or reproduced, and both sides thereof, including but not limited to, any memorandum, correspondence, letter, affidavit, court paper, transcript, diary, report, study, tel'egram, table, telex message, record, chart, paper, work paper, graph, index, book, notebook, pamphlet, periodical, tape, data sheet, data processing card, note, notation, minute desk calendar, appointment book, sound recording, computer print-out or microfilm.

DOCUMENTS REQUESTED (1) All documents which relate'in any way to any probabilistic risk assessments performed for the Seabrook Nuclear Power Station, including any draft or final reports and any internal documents relating thereto,

e Page 2 (2) All computer print-outs containing the results of any evacuation time studies that have been conducted by or for the NRC relative to the Seabrook area.

In our opinion, it is appropriate in this case for the NRC to waive copying charges, pursuant to 5 U.S.C.

5552 (a) (4) (A) and 10 C.F.R.

S9.14a "because furnishing the information can be considered as primarily benefiting the general public" and this office is a state agency to whom furnishing the records without charge is an

" appropriate courtesy."

The Massachusetts Attorney General represents the citizens of the Commonwealth of Massachusetts in the NRC licensing proceeding for the Seabrook plant and has an immediate interest and duty in ensuring that adequate radiological emergency plans can be and are developed to protect the citizens of the Commonwealth (See M.G.L.

c.12, Sl et seq.).

The Attorney General..has an immediate and real Interest in receiving the documents requested herein in order to prepare adequately for hearings before the Atomic Safety and Licensing Board on the issue of off-site emergency planning now set to take place this fall.

We understand that under the Freedom of Information Act, you must respond to this request within ten (10) working days, and that your failure to respond within that period of time is considered to be a denial of the request.
