- gi DUKE POWER COMPANY CATAWBA NUCLEAR STATION REPLY TO NOTICE OF VIOLATION 413,414/95-01-01 Notice of' Violation 10 CFR 55.21, Medical exainination, requires that a licensed operator have a niedical exarnination by a physician every two years and that the physician shall detennine that the licensed operator snects the requirentents of10 CFR 55.33(a)(1).
Contrary to the above, the results of two niedical exantinations perfonned on August 17,1988, and the result of one inedical exarnination performed on April 21, 1994, huproperly indicated that licensed operators met the requirernents of 10 CFR 55.33(a)(1). The exarnination results caused the operator's licenses to be issued without a license condition to require eyeglasses while perfortning licensed duties when a condition was required.

1.
Reason for Violation This violation is attributed to failure to determine that three licensed operators required a conditional license based on the results of their medical examination.

Corrective Actions Taken and Results Achieved Since 1991, a Site nurse has been assigned to assist the contract / corporate physician to ensure correct interpretation of the requirements and regulations governing the performance of licensed operator medical examinations.
In addition, a second Site Medical person now performs an INDEPENDENT verification of the examination results prior to the completion of the NRC Form 396 Vision standards for licensed operators have been posted near the vision testing machine.
Vision standards for licensed operators have been posted near the area where the physician reviews medical examination results.
Although not required by 10 CFR 55, vision testing is now performed for licensed operators on an annual frequency rather than a biennial frequency. This allows for closer monit..ng of borderline individuals and those with changing vision condiwons. Additionally, increased monitoring provides greater opportunity for error identification and correction.
Operations Training Management Procedures have been revised as follows:
When copies of completed NRC Form 3% forms are received by Operations Training from Site Medical, they shall be compared with previous NRC Form 396 license physical records in Training files to ensure that changes in status are noted and addressed appropriately.
Prior to submitting an NRC Form 398 (request for license renewal), all operator license data pertaining to the previous license shall be reviewed to ensure the appropriate license conditions are included on the NRC 398 (request for license renewal).

Since the implementation of the specified corrective actions, na errors in performance of licensed operator physical examinations have been noted.
Audit results, to date, have shown no errors in physical examination documentation.
A cover " check sheet" for licensed operator physical examination packages has been developed to facilitate compliance requirements and regulations.

Corrective Action to be Taken to Avoid Future Violations In addition to processes previously described, a comprehensive audit program has be established. Audits will be performed every 24 months.
Audits shall evaluate each licensed operator's physical examination results for the previous six year period. The initial audit under this program is currently in progress and will be completed by July,1995.
The medical guidelines, " Nuclear Operator Examination", will be revised to include the following statement:
"To ensure accuracy and compliance with the physical and regulatory requirements, all licensed operator examintations require independent verification from a qualified individual (individuals knowledgeable of ANSI regulations and medical criteria for clearance). Documentation is required by signature and date on Duke Power Company For 270745, Duke Power Medical Clearance." Corporate Medical will have this revision completed and distributed by April,1,1995.
