Dear Judge Wdlfe:

Counsel for the Staff, Louisa County and Vepco met in Washington on October 12, 1983. Counsel for Concerned Citizens of Louisa County did not attend, but he has discussed the re-sults of the meeting with counsel for Vepco and for the County

~by telephone, and he has reviewed a copy of this letter.

It became apparent early on that the parties were unlikely

-to make much-progress in terms of agreeing to specific state-ments of contentions and that it will be difficult to do so until the Staff Environmental Analysis and Safety Evaluation

' Report have buen published. Nevertheless, the meeting was a fruitful one. We accomplished two things.

1. We discussed Louisa County's contentions thoroughly, and this proved helpful to both the Staff and Vepco.
2. We agreed in principle that the proceeding should go forward promptly once the Staff documents have been published.

Toward that end, both the St'aff and Vepco will make informal discovery available to.the intervenors beginning right away.

In addition, I was authorized to recommend to you that we ad-here to the following time periods.

-(a) The parties would meet within 15 days after the publication of the Staff documents and make a good faith effort to agree on a statement of contentions that could

- be stipulated for the Board.

(b) Contentions that cannot be agreed upon will be submitted to the Board by the intervenors within 30 days after publication of the Staff documents.

(c)' Discovery will be. completed (i) within 60 days after the meeting of the ,

parties, for those contentions that-are agreed upon, and (ii) within 60 days after a Board order estab-lishing contentions, for those contentions that are not agreed upon.

(d)

  • In the event that unusual circumstances cause a party lto request an amendment to a time period agreed to here, the parties will attempt in good faith to agree on an appro'priate amendment. It is the present intention.of the. parties, however, to make every' effort to meet the time periods set out above.

We did not believe that we could usefully go beyond these steps in attempting to establish controlling time. periods.
