. 10 CFR 20.201. requires in part-that each licensee shall make or cause to be

-made such surveys as (1) may be necessary for the licensee to comply with the regulations'in this part, and (2) are reasonable ~under the circumstances to evaluate.the extent of radiation hazards that may be present.

Contrary to'the above on January 21, 1983, the licensee failed to perform an adequate neutron radiation. survey to evaluate the extent of the radiation hazards

. present' prior to permitting worker entry into a neutron high radiation area.

' Response:

Duke Power Company does not agree that'McGuire Nuclear Station failed to perform an adequate neutron radiation survey during' work in the fuel building on January _ 21,.1983.. Sound health physics judgement was used in the evaluation-of radiological conditions prior to permitting worker entry into a neutron high radiationfarea.

The work being performed in the fuel building consisted of removing an assembly

'from its transport cask and installing it into a position in the fuel vault.

Prior to entering the. fuel building, the neutron ball, which was being used for neutron dose radiation readings, was source checked (on the low range) and

- responded properly.

During the transfer of the source, notification was received of a blackout test which was about to begin.

Because of the pending-loss of power to the overhead crane:which-was handling the source, a decision was made to expeditiously

' place the source into the vault rather than leave it hanging in midair in a dark room'during the blackout test.

In order to place the assembly into the vault, a health physics technician must be close enough to the source to guide the assembly into its proper position in the vault. To maintain radiation doses as low as reasonably achievable (ALARA) for personnel protection, low and high range. gamma and

~ neutron radiation determinations were made. When the close range neutron reading.was made, the neutron ball experienced meter movement problems on the

. high scale.

In order to expedite the safe storage of-the source, a dose

- calculation was made to determine the neutron dose rate at close reage by utilizing the known gamma and neutron data. The source was then placed in the vault-prior to the blackout test.

- Duke Power concludes that the individuals involved in this process performed the required actions.and surveys which were reasonable under the circumstances.

Duke _ Power considers the exposure for the operation was ALARA, which indicates that the; job was. conducted in a radiologically safe manner. The extent of the radiation hazards present was evaluated adequately under the circumstances;

-therefore, no violation occurred.

~ Violation 50-369/83-26-02'& 370/83-33-02, Severity Level V:

.10 'CFR 19.ll(a) and (e) requires in part that each licensee shall post current copies of.any' Notice of Violation involving radiological working conditions within' two (2) working days of.the ^ receipt of the documents from the Commission.

Contrary to the above. the licensee received a Notice of Violation involving.

radiological' working conditions on June 6, 1983 (IE Report No. 50-369/83-19 and 50-370/83-26) which the licensee failed to post within two (2) working days Jafter receipt.

. Response:

Duke Power Company agrees that a Notice of Violation in IE Inspection Report 50-369/83-19 and 50-370/83-26 was not posted at McGuire Nuclear Station within two days after receipt;-however, the violation was evaluated and was determined not to involve radiological working conditions.. The violation involved the lack of calibration documentation on airline pressure gauges at McGuire. Prior to receipt of the violation,. the calibration of each pressure gauge used on a portable manifold was checked, and all were found to be within acceptable limits. There was never c question on the adequacy of radiological working

. conditions; therefore,10 CFR 19.11(a) and (e) were determined not to apply to this violation.

In the future, all violations at McGuire will be reviewed

-in a more liberal manner in order to avoid further potential violations in this area. 4
