SAPL'S MOTION TO STAY FURTHER LICENSING BOARD RULINGS PENDING REVIEW AND APPEAL OF SAPL' S MOTION FOR DISQUALIFICATION SAPL moves that this Board stay any further rulings in these proceedings until a review and ruling on i ts motion for disqualificction of Chairperson Hoyt. In the event that the Board denies SAPL's motion for disqualification, we urge the continued stay of any rulings in this proceeding pending immediate appeal to the Appeals Board. SAPL urges the granting of this motion in order to prevent any appearance of " judge shopping" on its part, to the extent that it might anticipate any continued adverse rulings by the Judge.
Should this motion be granted the present schedule for emergency planning litigation should be extended for the resulting length of the stay. This is necessary so as not to place undue burdens upon the~other parties in their case preparation.
