Dear Chairman Bloch:

Enclosed herewith is a proposed Subpoena to compel the appearance of Ms. Dora D. Hatley for a deposition on February 15, 1984.

We have also included a Notice of Deposition request-ing same and a cover letter to Ms. Hatley for your signature, as you requested.

We request that you sign the Subpoena to allow us to serve it contemporaneously with the Notice of Deposition.

He under-stand that Ms. Hatley is aware of matters concerning documentation and construction at Comanche Peak and the Cygna evaluation.

Be-cause these matters will be addressed during the hearings commencing on Feburary 20, it is necessary that the Subpoena be served on Ms. Hatley contemporaneously with the Notice of Deposition if we are to be assured of an opportunity to depose Ms. Hatley prior to the February 20 heari'ngs.

We have also enclosed a telecopied facsimile of a check payable to Ms. Hatley for travel costs and witness fees.

She will, of course, be given the check when the subpoena is served.

We plan to serve the subpoena today.

You will find enclosed a subpoena which I have issued today ordering you to appear at a deposition scheduled for February 15, 1984.

The exact time and place of the deposition as well as its subject matter are set forth in the Subpoena and Notice of Deposition.

We would greatly appreciate your cooperation concerning this matter.

By issuing the enclosed subpoena we do not mean to represent that your cooperation will not be volunteered.

The form of the Subpoena has been used by the Nuclear Regulatory Commission many years and its use in this proceeding is not unique.
