APPLICANTS' MOTION TO MOJIFY THE SCHEDULE ON ENVIRONMENTAL CONTENTIONS

-Applicants move the Atomic Safety _and Licensing Board to issue an' order modifying,'as set forth below,-the schedule for adjudicating environmental contentions'to account for previously unforeseen delays -in certain prehearing events.

I. The Schedule-Set in March, 1983 Following the second'prehearing conference, which was held on February 24', 1983, the Board issued-its Memorandum and Order (Reflecting Decisions Made Following Second Prehearing Conference),

March 10, 1983. There the Board adopted the following schedule for the: adjudication of already admitted-environmental contentions and j any.other environmental contentions subsequently admitted:

II. Schedule Adjustments in August, 1983 Only intervenor Eddleman advanced new/ deferred contentions-P based on the NRC Staff's draft environmental statement. On August 18, 1983, the Board issued a Memorandum and Order-(Ruling on Wells Eddleman's Contentions on the Staff Draft Environmental Statement) , in which the Board admitted Eddleman 8F(1) and (2) and 15AA, and deferred Eddleman 8F(3) and.85B. Pursuant to the pro-visions-of-the' March 10,J1983 Memorandum.and Order, November 16,~1983 (90 days after August 118) . would be the last day for filing discovery requests on .Eddleman 8F(1) and (2) and 15AA, and December 16, 1983

, Cont'entions and Miscellaneous Motions),-August 24, 1983, the Bo'ard, at Applicants' request, extended the' deadlines for filing motions for summary dispositions on certain of the admitted environmental contentions. The new schedule is:

Applicants recognize that the discovery schedule for new/ deferred DES contentions was agreed to and jointly proposed by

'the parties._ Several important and subsequent' developments, however, justify a departure from that schedule. First, at the time of the second prehearing conference it was understood that the DES would issue in late March, 1983. Tr. 470 (Barth). The DES was not served on the parties, however, until May 11, 1983. Second, the Board's rulings on the proposed DES contentions was delayed by the un-anticipated decision in Duke Power Company, et al. (Catawha Nuclear Station, Units 1 and 2), CLI-83-19, 17 N.R.C. (June 30, 1982),

which required further pleadings by Mr. Eddleman.

'Further, Mr. Eddleman is not prejudiced by the shorter discovery schedule. He has already filed first-round discovery requests on the new contentions, and should have ample time to file follow-up requests before October 14. It should also be noted that little other discovery is taking place at this time, since the parties agreed to defer discovery on several safety contentions until after the environmental hearing.

For all of the foregoing reasons, Applicants move that the 2/ The schedule for summary disposition of Dr. Wilson's contentions Eas been eliminated in anticipation of Board approval of Dr. Wilson's upcoming motion to withdraw his environmental contentions.
