IBEW Representative Statement of the Issues:

1. Were Mr. Pierce's actions caused by Commonwealth Edison Management's failure to provide adequate training or guidance regarding the applicability of DOA 300-12 while a QNE is present directing control rod' movements.
2. Did Mr. Pierce's error directly result from following the technical advice of an expert (the QNE)which was not clearly unreasonable and should not have been recognized as such.

After consideration of the evidence, the ultimate issue to be

decided by the Board shall be whether the Order should be sustained. .
