We have recently learned that the staff has provided the Commission with the results of its investigation into the alleged material false statenent made by GPU in 1979 in connection with the operator certification of the then
'IMI Unit 2 mnager of Operations, known in this proceeding as W.. In connection with this issue, the Union of Concerned Scientists has completed our review of GPU's " Investigation of W and O Incident", prepared for GPU by the law firm of Pepper, Hamilton and Scheetz, Harrisburg, and submitted by GPU to the Appeal Board and NRC on January 31, 1983. We are therefore enclosing for your consideration " Union of Concerned Scientists Comnents on
' Investigation of W and O Incident'".
'Ihe enclosed docunent denonstrates that this so-called " investigation" is a transparent effort, albeit a failing one, to exculpate GPU and its enployees rather than an unbiased investigation of the facts.
It. falls into the pattern which has characterized GPU's response to all the issues relating to managenent competence and integrity throughout this proceeding. GPU's subnittal of this " investigation" without qualification to the NRC constitutes canpelling evidence that GPU has failed to learn the most basic lesson and that it continues to react to problems within its organization by denying their existence rather than correcting then.
We urge you to consider this carefully in your decision on 'IMI-1 restart.
