PROPOSED LICENSE AMENDMENT - UPRATED OPERATION The purpose of tisis letter is to provide to the Staff an attached letter from the General Electric Company. The attached letter provides clarification of the affidavit for the proposed uprated operation license amendment for Nine Mile Point Unit 2 which was provided to the Staffin our letter dated July 22,1993 (NMP2L 1397). The General Electric Company letter discusses the non-proprietary nature of the no significant hazards consideration for the proposed uprated operation license amendment. This information is provided at the request of John Menning, Nine Mile Point Unit 2 Project Manager, NRR.

Affidavit signed by David J. Robare, dated April 30,1993 The purpose of this letter is to provide clarification regarding Enclosure 4 to the Niagara Mohawk Power Corporation letter dated July 22,1993 (NMP2L 1397) to the NRC which submitted the General Electric Report of Reference 1. Enclosure 4 to the Niagara Mohawk letter contained the General Electric Affidavit of Reference 2.
As stated in the Reference 2 Aflidavit "this document, taken as a whole, constitutes a proprietary compilation ofinformation." Release to the public of the information in Section 11.4 of Reference 1 is not deemed competitively significant and appears necessary for NRC processing of the power uprate application. Therefore, consistent with the Aflidavit, the " release" of Section 11.4 (Significant Hazards Consideration Assessment) for NRC use in processing the 10CFR50.92 application or in preparation of the SER for Nine Mile Point 2 power uprate of the Reference I power uprate report is acceptable to General Electric Company.
