1.0 INTRODUCTION

By letter dated August 27, 1991, the Baltimore Gas and Electric Company (the licensee) submitted a request for changes to the Calvert Cliffs Nuclear Power Plant, Unit Nos. I and 2, Technical Specifications (TS). The requested changes would revise TS 4.4.9.3.1 for both units. The revision deletes the designation of the power operated relief valves (PORVs) as Category C valves for the American Society of Mechanical Engineers (ASME) Code,Section XI, inservice Testing (IST) Program requirements. The surveillance requirements of TS 4.4.9.3.1 are retained and the PORVs are required to be tested in accordance with the currently-approved IST Program pursuant to Technical Specification 4,0.5.

2.0 EVALUATION The PORVs were des;gnated as Category C valves in TS Surveillance Requirement 4.4.9.3.1.d and in the First Ten-Year IST Program. However, that program aho included an approved relief request for the PORVs which delineated the specific testing to be done for the Category C valve designation since the PORVs are not of the ordinary design for self-actuating relief valves.

The licensee notes that a similar relief request was denied by the NRC staff during its review of the Calvert Cliffs facilities' Second Ten-Year IST Program. Subsequently, the relief-request was withdrawn and the PORV valves were reclassified as Category B valves and are being tested in accordance with the IST requirements of the ASHE Code,Section XI, as they pretain to Category B PORVs.

By letter dated September 11, 1991, the NRC staff indicated that the reclassificatinn of the PORVs to Category B valves is consistent with our position that PORVs be included in IST Programs as Category B valves arid found the reclassification acceptable.

The request to delete the valve category in TS 4.4.9.3.1d is necessary due to the reclassification, as discussed above.

In addition, TS 4.0.5 is referenced by TS 4.4.9.3.1, as well as in other sections of the TS, and specifically 9111000397 911021 ADOCK OSOOg7 DR

. requires that the IST Program be implemented in accordance with the applicable portions of the ASM Code,Section XI, except when specific written relief is granted by the Commission.

We have determined that the deletion of the PORV category designation is accceptable. This determination is based on the NRC staff's previous approval of the reclassification and that specific categories of valves need not be identified in the various sections of the TS because TS 4.0.5 requires that the IST Program be performed in accordance with the ASME Code,Section XI.

3.0 STATE CONSULTATION

In accordance with the Commission's regulations, the Maryland State official was notified of the proposed issuance nf the amendments. The State official had no comments.

4.0 ENVIRONtiENTAL CONSIDERATION t

-The amendments change a requirement with respect to installation or use of a facility component located within the restricted area as defined in 10 CFR Part 20, and changes the surveillance requirements.

The NRC staff has determined that the amendments involve no significant-increase in the amounts, and no significant change in the types, of any effluents that may be released offsite, and that there is no siqnificant increase in individual or cumulative occupational radiation exposure. The Commission has previously issued a proposed finding that the amendments. involve no significant hazards consideration, ar'd there has been no public comment on such finding (56 rR 47230). Accordingly, the amendments meet the eli forth in.10 CFR 51.22(c)(9)gibility criteria for categorical exclusion set Pursuant to 10 CFR 51.22(b) no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendments.

5.0 CONCLUSION

The Commission has concluded, based en the considerations disevssed above, that:

(1) there is reasonable assurance that the health ind safety of the public will not be endangered by operation in the propost 3 manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendments will not be inimical to the common defense and security or to the health and safety of the public.
