Dear Administrative Judges:

On January 26, 1983, the Board set a Prehearing Conference in connection with the operating license proceedings for Palo Verde Nuclear Generating Station to take place on February 24, 1983.

That Prehearing Conference is to provide an opportunity to discuss the disposition of West Valley Agricultural Protection Council, Inc.'s remaining contentions, the relief sought in West Valley's Petition to Intervene, and discovery and scheduling matters.

On February 2, 1983, West Valley filed a Motion for Ruling on Contentions, for Declaration that NEPA Analysis is Inadequate and for Continuance of Proceedings, a motion concerned with the matters scheduled for discussion in the prehearing proceedings.

Since the Board stated, in its Order of December 30, 1982 at page 14, that the remaining matters presented in West Valley's petition would be addressed at the Prehearing Conference, r302230350 830217 PDR ADOCK 05000528 O

However, I wish to reaffirm West Valley's intention to discuss the issues still outstanding from the Petition to Intervene, as further addressed in our recent Motion, as well as the need for a continuance of the operating license proceedings.
