Reply to a Notice of Violation Violation 50-369. 370/94-17-01 A.
10 CFR 55.25 states, "If during the term of the license, the licensee develops a physical or mental J
l condition that causes the licensee to fall to meet the requirements of 10 CFR 55.21 of this part, t
the facility licensee shall notify the Commission within 30 days of leaming of the diagnosis." 10 CFR 50.74 states in part, *Each licensee shall notify the Commission in accordance with 10 CFR 50.4 within 30 days of the following in regard to a licensed operator or seninr operator:...(c)
Disability or illness as described in 10 CFR 55.25 of this chapter."
Contrary to the above, on February 9,1994, an NRC licensed operator was given an annual physicalin which the licensed operators eyesight did not meet the minimum standards required by 10 CFR 55.33 (a) (1) as measured by the standards of ANSI /ANS-3.4-1983, and the facility licensee failed to notify the NRC of that change to the operators medical condition within 30 days.

Reason for the violation:
The reason for the violation is inappropriate Action. The site medical facility nurse failed to recognize the operator had failed the eye exam and therefore, did not notify Operations training staff of the change in the operators medical condition.

Corrective steos that have been taken and the resultS_Dd,l;sved:
a.
Upon discovery of the error on September 30,1994, medical personnel notified Operations training staff that the operator had not successfully passed the eye exam administered on February 9,1994. Upon notification, Operations training staff placed a medical restriction on the qualified operators list which removed the operator from active duty.
b.
The NRC was notified of the change in the operators medical status in accordance with 10 CFR 50.74. This corrective action was completed on October 20,1994.
c.
Medict bcility supervision reviewed the incident with all nursing personnel and implemented a double verification for operator medical exams, requiring a second nurse to review the exam results. This corrective actice as implemented on October 12, 1994.

10 CFR 55.53(e) states, in part, "If a licensee has not t een actively performing the functions of an operator or senior operator, the licensee may not resurre activities authorized by a license issued under this part except as permitted by paragraph (f) of 'his section." 10 CFR 5S.53(f) states, in part,"if paragraph (e) of this section in not met, beforr. resumption of functions authorized by a license issue under this part, an authorized represen'ative of the facility licensee shall certify the following:..."(2) The licensee has complete a minimurn of 40 hours4.62963e-4 days <br />0.0111 hours <br />6.613757e-5 weeks <br />1.522e-5 months <br /> of shift functions under the direction of an operator or senior operator, as appropriate, and in the position to which the Individual will be assigned. The 40 hours4.62963e-4 days <br />0.0111 hours <br />6.613757e-5 weeks <br />1.522e-5 months <br /> must have included a complete tour of the plant and all required shift tumover procedures."
Contrary to the above, NRC licensed operators were returned to active s'atus on August 31,1994, July 6,1994, and September 23,1993, without having made a complete tour of the plant. Security logs indicated that one operator entered and exited only the control room while performing the 40 hours4.62963e-4 days <br />0.0111 hours <br />6.613757e-5 weeks <br />1.522e-5 months <br /> of shift function required to retum to active status. Security logs for the remaining two operators also failed to show that complete plant tours were performed during the 40 hours4.62963e-4 days <br />0.0111 hours <br />6.613757e-5 weeks <br />1.522e-5 months <br /> of on-shift function required for reactivation of their license.
This is a Severity Level IV violation (Supplement 1).
Reolv to Violation 50-369. 370/94-17-02 1.
Reason for the violation:
The reason for the violation is inadequate Procedure. Operations Management Procedure, OMP 12-2, Maintenance of an NRC License, did not adequately address the requirement for licensed operators to perform a complete plant tour prior to returning to active status.
2.
Corrective steos that have been taken and the results achieved:
a.
Operations management discussed the failure to perform a complete plant tour with the three operators involved. On December 15,1994, the operators were removed from active duty.
b.
OMP 12-2 was revised to clearly define management expectations for a complete plant tour. OMP 12-2, Attachment 2, Certification for Retum to Active Licensed Duties, now requires signoffs for both auxiliary buildings, turbine buildings and the service building to ensure a complete plant tour is performed. This corrective action was completed on December 14,1994.
c.
An Operations required reading package was issued in all licensed operators on December 14,1994 to communicate the changes to OMP 12-2.
