Louisiana Energy Services, LLC (LES), also dba URENCO USA (UUSA) submitted an amendment request to Materials License SNM-2010 in the Reference 1 letter to amend the required nuclear liability insurance maintained in accordance to 10 CFR 140.13b.
In accordance with 10 CFR 140.15(e), UUSA requested the Commission to approve a change in financial protection. The proposed change was for a reduction in the nuclear liability insurance limit from $300 million to $100 million. UUSA demonstrated significant conservatism in determining that $100 million was adequate to meet the requirements of 10 CFR 140.13b. As a result of discussions with your staff, UUSA is revising its request and is requesting the liability insurance limit be reduced from $300 million to $200 million. The reduction is based on UUSA's demonstration that $100 million was sufficient and since AN l's current maximum limit for new facilities is $200 million1.
UUSA continues to consider options for further reduction of our liability insurance limits. These options include additional NRC requests and petitions for rulemaking.
