Dear Mr. Chilk:
On Monday, August 22, 1983, I received your recent letter regarding a revision in the schedule for Commission consideration of the NRC Staff's recommendation that the suspended low-power operating license for Diablo Canyon be reinstated.
As part of that schedule, you indicated that written comments should be submitted by August 23, 1983.
In light of the unprecedented level of activity in this proceeding at the present time, the Joint Intervenors have been unable to complete their written comments by the date requested.
In particular, the on-going reopened design quality assurance proceeding before the Appeal Board, including extensive discovery and, last week alone, a two-day prehearing conference in Bethesda and two days of deposition in San Francisco, has rendered impossible the submission of comments by August 23, 1983.
This letter is to inform you that the Joint Intervenors' comments will be submitted by September 1, 1983 and served on the Commission by express mail to provide the greatest opportunity for review prior to the September 13 meeting.
