By letter of August 5, 1983, I advised Mr. Baxter that Joint Intervenors were incapable of responding to Applicants' second set of discovery requests on Joint Contention II in timely fashion. I understand that counsel for Applicants were also informally advised of the same situation by Mr. Eddleman. Applicants have now filed a Motion to Compel requesting that Joint Intervenors be ordered to deliver a response to Applicants by this Friday, August 19th.

As I informed Mr. Baxter, Joint Intervenors' limited resources make it impossible to provide an adequate response to Applicants prior to some time in Septerber. Our delay in responding is in 4 no way the result of bad faith on Joint Intervenors' part, and we do not mean to prejudice Applicants ; but it is the reality that confronts us. We respectfully request your indulgence in this ,

matter.
