Dear Mr. Denton:

A loss of electrical load test was conducted at McGuire Unit I to satisfy condi-tion 2.C. (11).g of Facility Operating License No. NPF-9.

The NRC stated in Supplement No. 6 to the McGuire Safety Evaluation Report (NUREG-0422) that the test method was inadequate to satisfy the license condition and that the test must be performed as required before exceeding 50% power level. The attachment to this letter provides additional justification for Duke Power's position that the previous test was adequate to satisfy the license condition, and that another test need not be performed. We request that the NRC provide their concurrence with this position by May 10, 1983, the date when 50% power is expected to be achieved.

In support of this request, attached is a copy of WCAP-8921, "Setpoint Study, Duke Power Company, William B. McGuire Nuclear Plant, Units 1 and 2".
