SUPERSEDING COOPERATIVE NUCLEAR SAFETY RESEARCH MEMORANDUM OF UNDERSTANDING ADDENDUM FOR EXTREMELY LOW PROBABILITY OF RUPTURE VERSION 2 CODE MAINTENANCE, SUPPORT, AND DISTRIBUTION

Dear Mr. Wilmshurst:

Please find enclosed a signed Addendum to the September 30, 2016, Memorandum of Understanding between the U.S. Nuclear Regulatory Commission's Office of Nuclear Regulatory Research (NRC/RES) and the Electric Power Research Institute (EPRI) on Cooperative Nuclear Safety Research (NRC Agencywide Documents Access and Management System Accession No. ML16223A495). This Addendum describes a cooperative effort to maintain, support, and distribute the Extremely Low Probability of Rupture Version 2 computer code (the Code). It supersedes the Addendum dated September 4, 2018 (ML18169A208),

which was transmitted to you by letter dated August 24, 2018 (ML18169A207).

The superseding Addendum enhances the efficiency and effectiveness of the Codes maintenance, support, and distribution by eliminating the need to coordinate these activities through a third-party custodian. In the August 24, 2018, letter, I noted that while it was a mutual goal of NRC/RES and EPRI to distribute the Code internationally, further efforts were needed to establish an appropriate process. I am pleased to inform you that those efforts have been completed and the superseding Addendum describes the details of a mutually agreeable international distribution process.

Also enclosed is a signed amendment to the Cross-License Agreement dated September 19, 2018 (ML18169A209). The amended agreement supports the superseding Addendum by enabling both NRC/RES and EPRI to distribute the Code consistent with the process described in the superseding Addendum.

The superseding Addendum and amended Cross-License Agreement were developed through close collaboration between the NRC/RES staff and Mr. Craig Harrington of your staff. Our two organizations have worked well together over many years on development and applications of the Code. We look forward to the mutual benefits that wide distribution of the Code will bring under these new arrangements.
