Dear Mr. Starostecki:
This refers to Inspection 50-247/82-28 conducted by Messrs T.
Foley and P. Koltay on December 1,1982-January 3, 1983 of activities authorized by NRC License No. DPR-26 at Indian Point Station.
Your January 18, 1983 letter stated that it appeared that one of our activities was not conducted in full compliance with NRC requirements, as set forth in the Notice of Violation enclosed therewith as Appendix A.
Provided herewith as Attachment A is our response to Appendix A of Inspection Report 50-247/82-28.
Your attention is invited to an inconsistency in the numbering of inspection report items and this inspection report, e.g.: 82-27-01 (P.5) and 82-27-02 (P.18).
It would be appreciated if this fact could be noted to avoid confusion when these items are reviewed in the future.
In accordance with Section 2.790(d) and 73 21 of the NRC's Rules, Title 10, Code of Federal Regulations, correspondence and reports to or from the NRC which identify a licensee's control and accounting procedures for safeguarding licensed special nuclear materials or detailed security measures for the physical protection of a. licensed facility are exempt from disclosure.
We, therefore, request that Attachment A be withheld from public disclosure.
