This is to inform the Board that Applicants consulte'd with Mr. Eddleman today by telephone on the deficiencies Applicants per-ceive to exist in Mr. Eddleman's response of June 25, 1983 (in the form of a letter to the undersigned) to Applicants' letter of June 16, 1983, which restated Applicants' General Interrogatory No. 2 in light of the~ rulings made in the Board's Memorandum and Order (Ruling on Cost Savings Contentions, Discovery Disputes, and Scheduling Matters). The negotiations were unsuccessful, and Applicants now will consider the filing of a second motion to l compel discovery on this interrogatory. (The first motion, filed I

Any such motion will be filed within the next ten days.

There are several procedural points raised in Mr. Eddleman's letter which, while not material to the disputes, call for a response.

First, Mr. Eddleman states that we are erratically going "on the record" and "off the record" for negotiation discussions. These are Mr. Eddleman's characterizations of our requests that, in certi-fications to the Board, the parties merely summarize the efforts made and results reached. In early certifications, Mr. Eddleman was attemping to report specific statements made by him or Applicants during the conversations. This approach was leading either to the need for detailed written rebuttal to Mr. Eddleman's certifications (a waste of time) or to an inhibition in the dialogue which would severely j limit the opportunities for success. At any point, however, it is appropriate for a party to go "on the record" with its own positions, as I did in the June 16 letter, and negotiations need not always '

Mr. Eddleman also states that my letter is not timely. First, he ignores the fact that the Board's Memorandum and Order was served on May 31. Second, the Board's ruling was not a discovery response within the meaning of 10 C.F.R. 2.740 (f) which triggers a schedule for filing a motion to compel. Third, my letter of June 16 was not a motion to compel. Finally, it is arguable that Mr. Eddleman had an independent obligation, on his own initiative, to supplement his earlier responses to General Interrogatory No. 2 since the Board

, in part granted Applicants' motion to compel.

This contrasts with a written communication which merely announces i that negotiations purportedly have begun.
