Dear Mr. Runkle:

As per our phone conversation yesterday, please find enclosed a copy of the Protective Order Governing Access to Security Plan Information and Affidavit of Non-Disclosure proposed by the Applicants for the security plan phase of the Harris -

proceedings. In that conversation you informed me that you were now counsel for Intervenors Wells Eddleman, Conservation Council of North Carolina and Kudzu Alliance for security matters, but you have not as of this date informed the Board or any other parties of this. You agreed to promptly provide that notice. Such notice should include a Withdrawal of Appearance by Deborah Greenblatt. It snould also be noted that in your position as counsel for Intervenors regarding Security Plan issues you will not be able to act in your capacity of Executive Director of the Conservation Council to the extent that you will be prohibited from disclosing a6y security pla: 1 protected information and/or having any discussions thereof with Council members.

In good faith reliance upon your assurance that you will provide the appropriate

' notice, we forward you the enclosed documents. You will note, however, that those documents contain the name of Deborah Greenblatt as counsel for Intervenors, which name we will revise as soon as the notice of the change in counsel is received and is approved by the Board.

You indicated that you would like to meet at 2:00 p.m. In the offices of Carolina Power & Light Company in the 13th Floor Conference Room No.1137 on Wednesday, July 13,*to negotiate any problems Intervenors may have with the order and affidavit as
