Dear Mr. Clark:

Fort Calhoun Station Technical Specification Amendment Application Regarding Inoperability of Reactor Protection System (RPS) Channels This is in response to the Commission's letter dated May 23, 1983 concerning the above referenced application.

The May 23, 1983 letter presented the Commission's position re-garding the District's request for amendments to our Techni-cal Specifications and stated that our proposed amendments were unacceptable.

The May 23, 1983 letter also provided a draft specification and requested that the District submit an amendment application consistent with that draft.

It was stated that if we were unable to accept the Technical Speci-fication amendments as proposed, a meeting should be l

scheduled to discuss and resolve these issues.

The District has reviewed the draft Technical Specification amendments proposed by the Commission and are still unable to propose an amendment in the form recommended.

There are a number of reasons for our being unable to propose the Technical Specifications as recommended by the Commission.

First, the present design of the Fort Calhoun Station re-quires that jumpers or blocks be used to bypass those chan-nels which are not currently equipped with key operated by-pass switches.

Second, we believe that the 48-hour bypass l

limit for all RPS/ESFAS channels presents a high potential for imposing severe financial penalties without a commensu-rate increase in the health and safety of the public.

l Third, the existing design of the ESFAS channels requires the installation of jumpers or blocks and, therefore, the requirement for placing an inoperable channel in the tripped condition within the one-hour time period may not be possi-Op\\

ble since technicians have to be called in to perform this operation during off-normal duty hours.
