Dear Mr. Guild:

This is in reference to our recent conversation regarding Applicants' Supplemental Response to Palmetto Alliance's Interrogatory 2 on Contention 44.

As I explained during our conversation, one document responsive to that request contains proprietary information.

The document in question was prepared by Babcock and Wilcox, and is entitled " Response to NRC Request for Information on Reactor Vessel Material Surveillance Program." This report was transmitted to the NRC Staff on August 31, 1977, together with a request, supported by appropriate affidavit, that it be considered proprietary and be withheld from public disclosure pursuant to 10 CFR 2.790. Upon review, the NRC Staff granted the request and the report has been accorded proprietary status. In accordance with your request, I am providing information which explains why Babcock and Wilcox considers the information proprietary, and which formed the I

basis for the NRC Staff's conclusion. This is the affidavit of James H. Taylor.

I have prepared, and am enclosing with this letter, an affidavit of nondisclosure which I would ask that you, or

shoever you designate to review the material, sign and return l to me. Upon execution and return of the protective agreement,
