APPLICANTS ' MOTION FOR ADMISSION OF AFFIDAVIT REGARDING STRUCTURAL INTEGRITY TESTS Pursuant to 10 C.F.R. 52.730(c), Texas Utilities Generating Company, et al.
(" Applicants ")
hereby move the Atomic Safety and Licensing Board (" Board") to receive into evidence the attached Affidavit of John T. Merritt, Jr. regarding the structural integrity test of the Unit 1 containment for Comanche Peak.
I&E Report 79-11 (Applicants' Exhibit 44C) addresses the placement of a small amount of concrete in the Unit 1 dome to replace concrete that was washed out by a rainstorm following a concrete pour.
Applicants conducted a technical evaluation of the structural integrity of the concrete placement, and the NRC Staff cloced the matter in I&E Report 79-24/23 (Applicants' Exhibit 44D), subject to verification of the Unit 1 contain-ment structural integrity by satisfactory completion of the structural integrity tests to be performed pursuant to 10 C.F.R. Part 50, Appendix J.

- Applicants and the NRC Staff addressed this issue in testimony presented at the licensing hearings.
Applicants' Exhibit 44 at 6-9; NRC Exhibit 13 at 39-40.
CASE presented no witnesses or documentary evidence on this matter.
As addressed in the Merritt affidavit, the structural integrity test for Unit 1 containment was completed successfully on January 26, 1983.
The test results confirm the structural integrity of the entire Unit 1 containment, including the specific portion of the Unit 1 dome that was repaired.
Admission of the Merritt affidavit is appropriate for rounding out the record on this subject, and no party will be prejudiced by admission of the affidavit into evidence.
Applicants have designated that affidavit as Applicants' Exhibit 155 for identification, pending a ruling by the Board.
