DOCKET NOS. 50-266 AND 50-301 REQUEST FOR HEARING REGARDING ENVIRONMENTAL QUALIFICATION-OF SAFETY-RELATED ELECTRICAL EQUIPMENT POINT BEACH NUCLEAR PLANT, UNITS 1 AND 2 By letter dated August 14, 1981 to Mr. Jay E. Silberg, Counsel for Wisconsin Electric Power Company, Mr. Eisenhut stated
'that Wisconsin Electric would have until 30 days after the Commission completed action-on the industry petition to extend the June 30, 1982 deadline'for environmental qualification.in which to inform the NRC of our intent on requesting a-hearing regarding the Order imposing environmental. qualification requirements on Point l Beach Nuclear Plant, Units 1 and 2..
The Commission published its final rule on environmental qualification, i.e.,
-in~the Federal Register ~(Volume.48, Number 15, Page.2729) on January 21, 1983.
That final rulefwill become effective on February'22, 1983 at which time-Commissior.: action on the industry petition will be completed.
We are in the process of reviewing"that rule.
We have We will not yet determined whether we wish to request a hearing.
make that determination within the 30-day period following February 22,.
i.e., by March 24, 1983, and will advise you of our' intent.in writing by that date.
If this additional 30-day period to review the rule cannot be granted, then Wisconsin Electric hereby requests that a hearing be' conducted on the issue of'whether all safety-related electrical equipment at Point Beach should be environmentally qualified in accordance with the Order as modified by the rule.
