Certain vendors have stated that their qualification information is proprietary and expressed concern to the possible unfair trade advantage and conflict of interest regarding the review by Franklin Research Center. Specifically, Westinghouse has requested (Attachment) that Alabama Power Company not submit their proprietary information to Franklin Research Center. Pursuant to an agreement reached between Westinghouse and Mr. E. C.

Shomaker of the NRC Office of the Executive Legal Director, who has discussed this matter with Mr. Z. Rosztoczy of the Equipment Qualification Branch, Westinghouse will ensure that the requested information is, or has been, submitted to the NRC on a timely basis. Therefore, the information other than proprietary Westinghouse qualification documents has been retrieved from our auditable central file and is forwarded directly to your of fice to ensure the proprietary understandings between Alabama Power Company and the vendors have not been disregarded or neglected.

Alabama Power Company requests that the entire submittal be reviewed by your office and only information which is not proprietary, as designated below, be submitted to Franklin Research Center. Additionally, no part of this submittal should be released for public disclosure or reproduced, and the entire submittal must be returned to Alabama Power Company upon completion of the review. The qualification documents for Items 1.b, c, d, f, and n were previously submitted for your review by our Unit I letter dated February 19, 1982 and, therefore, are not enclosed. For Item 1.e, NAMCO Test Report dated November 21, 1977 is superceded by a revision dated September 5, 1978. The 1978 revision was submitted by the Unit I letter in lieu of the 1977 report.

In order to provide for a proper review, Alabama Power Company has enclosed the most complete and latest qualification information that, for certain items, amends or enhances your request. Qualification documents identified in your Items 1.h, i, and 1 are not applicable to Farley - Unit 2 as stated in our letter dated February 20, 1981, " Environmental Qualification Review";

consequently, the requested qualification documents are not included in the Farley auditable central file. For Items 1.1 and 1, the applicable document, Joy Manufacturing Company Test Report X-604, is enclosed. For Item 1.h, Franklin Institute Research Lab (FIRL) Test Report F-C3834 dated March, 1974, Bechtel/ Gems telecon of April 3,1980 and Isomedix Test Report dated November,1975 verify qualification for the Delaval GEMS level transmitters. The FIRL Test Report should be available from your contractor for review. The Bechtel/ Gems telecon requested by your Item 19 and Isomedix Test Report are enclosed for your review.

As a note of clarification, our NUREG-0588 response, Section C.2.4, sheet 10 inappropriately referenced WCAP-9985, which is requested by your Item 1.p. The proper reference is WCAP-9885

Alabama Power Company J. M. Farley Unit 1 and 2 SAFETY EVALUATION ON EQUIPMENT QUALIFICATION Recently the NRC has issued letters to some utilities regarding the results of the staff review of the utility response to the Safety Evaluation on Equipment Qualification. The letters (samples attached) request certain EQ information from the utility central file be forwarded to Franklin Research Center to facilitate the NRC contractor review.

Where the requested information is not proprietary to Westinghouse, it is appropriate for utilities to submit such information directly to Franklin.

Pursuant to an agreement reached between Westinghouse and Mr. E. Shomaker of the NRC Office of the Executive Legal Director, who has discussed this matter with Mr. Z. Rosztoczy of the Equipment Qualification Branch, we ask that you not submit Westinghouse proprietary information to Franklin. Westinghouse will ensure that any such requested material is, or has been, submitted directly to the NRC on a timely basis.
