Nuclear Regulatory Commission Attention: Document Control Desk Washington, DC 20555 Gentlemen Subject s Oyster Creek Nuclear Generating Station Docket Number 50-219 10 CFR 50.44 By letter dated November 6, 1990, the-NRC staff responded to GPUN's July 17, 1989 letter regarding compliance with 10 CFR 50.44 and requested that Gi'U Nuclear respond to the staff's letter within 60 days.

As indicated to Mr. Varga of the NRC during our telephone conversation on December 14, 1990, GPU Nuclear has reviewed the staff's letter in detail and will require additional time to develop an appropriate response.

The Safety Evaluation, Enclosure 2 of your letter, addressing NEDO-22155, represents the first time that the staff has provided a technical basis for its position that it is inappropriate to use NEDO-22155 for demonstrating compliance with 10 CFR 50.44(g). Members of our Technical Staff in concert l with General Electric Company personnel are reviewing your staff's concerns.

Based upon our current estimate a formal response will be submitted by May 31, 1991.
