Dear Mr. Denton:

This letter is in reference to 10 CFR 50.71(c) which requires each holder of an operating license for a nuclear power reactor to update their Final Safety Analysis Report (FSAR). The first updated FSAR is to be filed within 24 months of either July 22, 1980 or the date of issuance of the operating license, which-ever is later.

McGuire Nuclear Station is a two-unit station which has a combined FSAR for the station. Duke Power Company received a license (NPF-9) for fuel loading and zero, power testing for McGuire Nuclear Station Unit 1 on January 23, 1981. On June 12, 1981 Duke Power was issued the license (NPF-9) to operate at power for McGuire Nuclear Station Unit 1.

This license is effective to date as amended.

Duke Power Company is presently in the licensing process for McGuire Nuclear Station Unit 2.

In order to include an FSAR which contains current information with the Unit 2 application for an operating license, Duke Power has submitted two revisions to the combined FSAR since the licensing of Unit 1.

These re-visions were submitted in December, 1981 and October, 1981 and included updated information on Unit 1 as well as some specific information to support licensing of Unit 2.

With the filing of these revisions, it is Duke Power Company's position that the intent of 10 CFR 50.71 is being met, i.e.,

to maintain an up-to-date FSAR. Submittal of an updated FSAR in January, 1983 (24 months after receipt of the initial license on McGuire Nuclear Station Unit 1) would serve no useful purpose and would result in two different versions of the FSAR, one version to support licensing of Unit 2 and the second for Unit 1, only to meet 10 CFR 50.71.

This would also result in much confusion to the holders of the FSAR.

Accordingly, it is Duke Power Company's intent to submit an updated FSAR 24 months after the issue date of the McGuire Unit 2 operating license. Please advise us if there are any questions regarding this proposal. We would be pleased to discuss this with your staff at your convenience.
