Dear Judge Hoyt:

In response to the request you mad e during our l telephone conversation on Monday, August 30th, I have talked with counsel for the Licensee and for the NRC staff in the above-captioned matter to determine dates during September when counsel for all of the parties would be available for a prei. earing conference.

l I spoke with Richard Bachman, counsel for the NRC l staff,.and with Robert Brittigan, counsel for the Licensee (speak'ing on behalf of himself and Mr. Rickard). The dates

.of September 21st, 22nd, 23rd, 30th, and October 1st are acceptable to counsel for all of the parties. (My co-counsel, Elizabeth Entwisle,and I would prefer a Friday meeting, if possible.)- Mr. Bachman has noted that the Commission has extended the time to consider whether to review the appeals board ruling granting intervention in the Cobalt-60 storage facility matter until September 24th; he suggested that it might be advisable to ascertain whether and what action l the Commission takes on this item (on or before September 24th) before our prehearing conference.
