Dear Mr. Clark:

Application for Amendment of Fort Calhoun Station Operating License Regarding the Definition of Maximum Thermal Power Level Omaha Public Power District submitted the subject amendment application, dated December 21, 1982, to revise our operating license to clarify the definition of plant operation at a steady-state power level of 1500 megawatts thermal.

The purpose of th!s letter is to formally notify your office that the District would like to withdraw this application from Commission consideration.

The reason for withdrawing this appli-cation is that the District was recently informed of the Commission's interpretation and position regarding the definition of an " average power level", as detailed in a Commission internal memorandum on the subject issue.

This interpretation of an average power level is con-sistent with the District's intent in submitting the December 21, 1982 amendment application. Therefore, a license amendment is unnecessary and the operation of the Fort Calhoun Station will be consistent with the restrictions of our present operating license and the guidelines of the subject memorandum.

Additionally, the District submitted a $4,000.00 check with the subject amendment application as payment of the required processing fee for such applications.

Since the application has been withdrawn, the District respectfully requests return of this money. A check issued to the Omaha Public Power District would be the appropriate means for completing this reimbursement.
