Dear Mr. Clark:

Proprietary Information Contained in the Fort Calhoun Station Technical Evaluation Report (TER) on Electrical Equipment Qualification The Comission's letter dated January 11, 1983 transmitted the subject TER to the Omaha Public Power District.

The Safety Evaluation Report (SER) attached to this letter requested the District identify all proprietary information contained in the TER and justify the reason (s) for withholding this information from public disclosure. Accordingly, the attached identifies the TER pages which are proprietary and the following details the justification for withholding this information.

In accordance with the SER, the District transmitted a listing of the proprietary pages contained in the TER to the Office of Nuclear Reactor Regulation, via our Project Manager, on January 24, 1983. The rationale for withholding this information is consistent with the considerations detailed in 10 CFR 2.790(b)(4).

However, the basic reason for withholding this information is that the equipment operational and testing parameters listed in the TER are competitive commercial information. As such, our vendors granted permission to Franklin Research Center to conduct a review and evaluation of this proprietary data and public disclosure could degrade or eliminate the competitive position held by these vendors.

Therefore, the TER pages identified in the attached must be withheld from disclosure.
